Hi there

 

I have posted about this debt on the debt forums but now I just want to know what will happen on the 14th.

 

I have not been served with the petition as yet - they said they were not in my area at the time I said I was available and have sent the petition back to the creditor.

 

I have paid £600 and made a payment arrangement with the creditor and I have paid the first months payment.

 

I can not reach the bankruptcy clerk on the phone as he is never at his desk.

 

So what will happen on the 14th?

Hi there

 

I just want to know what happens when I get to court. Should I hire someone, what happens when the judge realises that they haven't served the petition, what happens when the judge is told that I have paid a lump sum and have entered into a re-payment plan - that kind of thing.

 

Obviously by paying the lump sum and making a payment planI have admitted the debt and as I am the one being taken to court I can not stop the proceedings only the creditor can.

 

What can I expect to happen?

Well, after over 100 views of this post, and apart from the first post, no one has replied so I take it no one has actually reached court in a bankruptcy case.

 

I have contacted a local solicitor so will post their advice once I have seen them so that anyone who is in the same position as me will know what to expect.

personal bankruptcy? see section 271 3 insolvency act re compounding.

if in a realistic repayment plan, bankruptcy should be unlikely according to that section. surprising that they are continuing with petition then. depends on the circumstances.

no deemed service of petition? something also to challenge.
