I'm hoping they wont get time to, because there isn't really that long between now and 3rd Jan, what with Xmas in between. :D

 

I just have this horrible feeling that dealing with your claim is going to take up all their resources between now and January, I won;t get their defence in time, I'll get cross, call the Court on Jan 4 and...

Get a default judgement!

Perhaps I should give Cobbetts a call then and keep them on the phone for a couple of hours, then the same tommorrow, then the next day and so on right up til 3rd Jan. Do you reckon that'll keep them busy enough.....then you can all file for judgement!

Apparantly on BBC2 tonight 10pm Moneywise programme will be looking at people who've successfully claimed back bank charges, lets hope Cobbetts are watching and decide to throw in the towel.

Well that looks like you are getting somewhere at last Dellar, hope you get your money by then, definitely don't think they can get defence redone by 4th January if it takes them until a deadline of 28 days to get other defence's in.

well i looked for that program but it wasnt on

18/10/06 sent lba for current account

18/10/06 claim issued against NatWest for £2,495.00

30/09/06 O'Neill V NatWest - declined offer of £1216.00 sent responce to settlement letter

30/09/06 O'neill v Woolwich plc mortgage account sent Data Protection Act notice for not replying

30/09/06 Oneill v citifinancial sent S.A.R - (Subject Access Request)

30/09/06 O'neill V Capital One sent S.A.R - (Subject Access Request)

The programme was ok but for all of us already claiming, it is basically what we all ready know, but the bank trying to change tactic and call it a service!!!! I think that is even more disgusting. And now we know that £2.50 to the highest of £4.50 is what they should be charging us, which we basically knew all along.

 

Also Dellar:

What you have had through from the court, is it Bristol Court?? If so maybe I should of changed court on AQ as Bath seem to be very slow.

And those are at the very top end, according to the boys in blue suits.

I found it quite uplifting, thinking of the hundreds of thousands (or more) people watching, who will now go after the banks for their money back.

And what about the bank execs who were watching? Surely, they must know the game is up if even the Ombudsman is saying, loud and clear, justify the charges or pay them all back.

As for calling it a 'service', well, bring it on! Sale of Goods Act; and the Unfair Terms in Consumer Contracts Regulations, plus - haven't we all asked them about manual intervention? There is no service.

Didn't Angela Knight look shifty and unconvincing??

And what about the judges who may have been watching?

Fascinating read this post..has inspired me to start my own claim with Nat West (It's only £300 but what the hell eh?) I just rang them actually, and they're going to send me all my statements from last 3 years (only had account that long), and it'll only cost me £5, have to say that the lady I spoke to knew about the BBC prog gone out tonight and she was REALLY nice to me and very helpful!! -- hmmmm, sign of things to come I hope!

Just hate every DCA out there

You are young, grasshopper, but you will learn!:)

The individuals, in the branches especially, are generally very pleasant and well-meaning. But just wait till you encounter Customer Relations Department (their idea of relations seems to be more carnal than caring - i.e., they want to screw you), Stuart Higley and - most dread of all - the jabberwok that is....Cobbetts!

(Parents cover their children's ears; old ladies look shocked. CofE vicars implore society to show understanding and compassion):D

No matter - there are plenty of people willing to help. They may take over your thread and argue about an arcane point of law for a while, but they mean well.

Set up your own thread, keep us posted with your progress and feel free to ask any questions you wish. If we can help, we will.

So what will become of their new tactics, perhaps the banks will try and use these figures to calculate early settlement offers. We already know the credit card companies are making offers of "the difference between the charges incurred on the account and the new OFT ruling of £12 maximum charge". It wouldn't suprise me in the least if the institutions started refuting to making offers of "the difference between charges incurred on the account and what is deemed to be the maximum allowable charge of £4.50", and then trying to use the arguement as stated on T.V.

 

I can only see this becoming a bigger problem for the banks afer last nights show, which will eventually make the courts even busier (as if they couldn't cope already), and probably make the whole process for the likes of you and me an even more drawn out one. I'm glad I started when I did, but also can't wait to se what sort of revolt against the banks this causes.

I missed the show, but am utterly delighted to hear it! will have a quick squizz at the website link and quote it with abandon in Natwest today.

 

Re customer service - I have found everyone in Natwest to be lovely and v helpful ... right up to Mr Higley and the lady who called me at the end of last week demanding I get my overdraft back under the limit that is now over the limit because of the charges, and of course will be another £28 over the over because of the charge created by the charge for being over ... :mad: ... oh the joys of modern life ... x Debs
