First I'd like to say thanks for all the info on this site, its really helpful!!

 

I've just received my detailed statements back from the Nationwide after sending them the DPA letter and am about to send them a request for repayment £2635 + £385.94 Interest on Overdraft.

 

I'm not too sure where I should be sending this to though, Is it to my branch?

 

Also I did include a paragraph in the DPA letter about disclosure of any indication or notes relating to manual intervention (as set out in your standard letter) and the letter that they've sent back to me now has a paragraph as follows:

 

"There are many events in the history of an account which involve manual intervention. OVer the course of the last six years, manual processes may have been applies to your account in order to ensure the smooth running of your facilities. If you have conducted any of the following activities, some degree of manual intervcention will have been involved, however, please note this is not an exhaustive list, but will provide guidance:"

 

It the goes on to list virtually everything you can do with a bank account!! eg:

Account opening

Cash Deposits

Cash withdrawals at counter

Card transactions

Cheque transactions

TT

Change of address

 

The list has about 25-30 items on it.

 

What does this mean? Are they pre-empting my next move and trying for a get out clause?

What you are looking for is 'manual intervention' that has dates that corrosponds with when they have taken charges. Seen as it is all done automatically there won't be any ( but still check ) they use manual intervention as a reason for the high charges.If you have the proof that there wasn't any on them dates then that is that defence blown out the water for them.
