If they took you to court after this, they would be very very stupid to do so. The first question by the judge would be, " Why did you stop Mr xxx from paying off the debt as he has been doing?"

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

On their last letter telling me the options they are looking at ie

Selling debt

Court

Placement of debt with agent to obtain (full amount) can they do that?

It goes onto say

What If I am currently making payments each month?

Please continue to make these payments.

We may decide to sell your debt, but if we do we'll make sure we pass on ALL your payment details etc.

They do not even adhere to their own procedure.

I have found an email so emailed them

It cost every time I write as I send it recorded for proof of them getting in, an email is as good in my eyes in this instance.

How do I go about seeing if I have any PPI payments I can claim back.

Who do I contact worth a recorded for that what do I ask.

Sorry for sounding pathetic, but struggling at the moment.

If you are going to ask things like that, we will have to set up a jokes section. :)

I think they charge about a fiver per statement (different banks different costs), so if you are a few short, for a tenner you can get a copy of them all with an SAR..

They have not even acknowledged my email about how they suggest I continue to pay when they have stopped my online payments.

I am not going to write because that means cost to send recorded.

I have proof that I emailed them - although I dare say that counts for nothing.

My sympathy goes to you.

 

Credit card companies (particularly MBNA, but also Nationwide and Barclaycard in my experience) disgust me.

 

I somehow find it hard to believe that real people are behind the nasty letters and unnecessary threats.

 

Until recently I had four credit cards which I was paying off (two of them MBNA) totaling in all £10,000.

 

The debt was manageable until the crunch hit and being unable to move the balances around meant the 0% rates ended,

extortionate rates kicked in and the rug was pulled from under me.

 

I didn't see it coming any more than they did.

 

After three years of struggling terribly but never missing a minimum payment, I'd had enough and finally sold my house to pay off my debts to be rid once and for all,

only to be approached by the very same immediately offering more credit cards. AS IF!!!

 

I had the GREATEST PLEASURE in telling them to stick their credit cards and aggressive way of doing business where the sun don't shine.

 

I am now debt free and fully intend never to deal with the likes of them again.

 

I very much hope you resolve your issue in the knowledge there's at least one person out there who is no longer being screwed for every last penny

in ridiculously high interest rates!

 

I might have had to move but it was worth every saved penny!

Sunshire thanks for your reply; that was a horrible experience to go through.

I am glad, that you feel happier they have at last gone away.

I get frightened by it all - I was paying the £10 a month which is a lot.

I know I owe them but I am claiming ESA live alone and have no funds, the house is mortgaged - what can I do.

 

I have always been honest with them - but you get treated like dirt.

One minute the threatening letters about court - the next they have removed the ability to pay.

 

What an eye opener dealing with MBNA has been.

as we were in court recently and found that proof of any correspondence was vital to cases and ion our case saved us £1,000+ in cost so a lesson for all there keep receipts attached to letters etc.

 

That is why I will never ring anyone and always get proof of postage and their sig at the other end.

Or in this case email which I have printed out.

It is a pain in the butt having to keep doing all of that - but these people lie so we have to cover ourselves.

I have sent a cheque for £10 with a covering letter asking how they expect me to continue paying (as they suggested I did) until I hear what they are going to do next with my debt.

Sell or court proceedings.

 

What do I do in the meantime, do I just wait to hear back from them.

I am sick with worry.

What should I expect.

 

An intro from AK or one of the collection agencies.

if you are going to pay them, go to their site and look for payment (so called plans) and choose one the discount you get is rubbish, but you can set up on their site = take a read there and make your mind up, that is if you are going to pay the fleecers, it is up to you and your actual cirumstances, i.e. correct CCA1974 etc or if you just want a bit of piece?

 

only action if you actually hear from Aktiv Kapital?

I only have the letter from MBNA at the moment telling me that are in the process of selling my debt to them along with the rights of collection, and I should be hearing from AK AS in the near future.

So I will do nothing until I see what they have to say.

 

I can offer no more than I am paying MBNA at the moment so will have to wait and see what they ask for.

What are they like to deal with.

AK are debt purchaser how this is handled from now on will be much dependant on the collection agency they use.
