I've been paying CPP a fee since 2001 via my old Associates cum CITI now OPUS card

and after reading the threads and forums I wrote to CPP in March this year to begin the process of my fee reclaim - they ignored my letter!

I again wrote on the 7th July to remind them that I was waiting for a response and I gave them 7 days to respond - guess what?? Nothing yet!

How do I respond to the lack of responses from CPP or what is my nesxt step?

Hi JP,

ok did you send the requests by recorded delivery ?

Also did you keep a copy of the letters sent ?

I will help you with this one, since your issues are the same as mine, aside from my Citi Account being defaulted and assigned in 2003.

so if you wrote again on 7th July lets assume 2 days for rec which gives a deadline of 16th.

If nothing by then report back here and hit the report tab just in case I miss it.

Thanks Martin, just to let you know that I didn't send the letters recorded

- the first was just standard mail and the second was faxed but I did get a 'successful' report back and of course it's recorded on my telephone bill.

I have filled in the Compound Interest Calculation given in a forum and it makes interesting reading!

I shall wait now until the 16th and report back to you then.

Hi Martin, I wanted to put you fully in the picture with events so far; my last fax' to CPP went as follows -

"It appears that I have received NO RESPONSE to my letter addressed to you and dated March 28th 2012. I therefore request that you acknowledge receipt of this letter within SEVEN days of your receiving it. I have held a policy with Card Protection Plan Ltd since 26th September 2001 paying a premium, it appears, of £29 annually by credit card. Firstly, I wish to make it clear that I am cancelling this policy with immediate effect. Furthermore, and In the light of the recent press and FSA involvement, I wish to make it known that I believe I was mis-sold this policy in the first instance and am seeking redress."

.

I have received a response today(as attached) acknowledging my cancellation request but totally ignoring my request for redress! Time for the next step I believe!!

Sorry for the late reply.

My associates card was also arouind same time as yours.Citi rebranded Associates as you know.CPP were quite quick to respond to my letter second time around, after I made it known I was aware of the OFT investigation which found them to have mis sold policies.

The OFT looked at more recent policies, and some of those customers were sent out new policy documents around March 2011,which advised them that they had been sent out the wrong ones when they took out their policies due to system errors.

CPP sent me a reply to say that they were not liable since it was Citi who I made the agreement with.

CPP said they were merely sent details afterwards.

As I remember, the debits for the card protection were taken at monthly intervals and appeared on the Associates and later Citi statements.

One thing I do remember also is that at year end the policy was automatically rolled over.

CPP advised me that they had informed Citi of my letter, and about 2 weeks later,a letter did in fact arrive from Citi along with a FOS form which they requested I fill in and send.

My understanding therefore is that earlier policies are the responsibility of Citi, and only later were CPP liable themselves.

I would imagine that this will be the case for you,so I would guess that Citi are liable for the earlier period, whilst CPP themselves will be liable for the later ones.

Most if not all,of the major card issuers, used CPP but its not clear on the position as regards who is liable in all those instances.

The FSA investigation ruffled quite a few feathers, and led to Barclaycard announcing they were suspending their relationship with CPP in the wake of allegations of mis selling.

I am not sure whether they have resumed that or not.

I see and thanks for the informative response Martin3030. Did you get a satisfatory resolution to your FOS or is it still ongoing?

My next step was to send CPP the compound interest calculation spreadsheet found in another thread earlier - what might your suggestion be?

Also, did you get the opportunity to look at the Opus letter I sent to you in the PM?

Yes I think you need to send them your figures, and if they will say they are not responsible for all or part, then demand clarification of which.

I also think you should be firm and say if they ignore you again, you will make a complaint ton the FOS.

Do you mean the Opus letter in the message sent 2 weeks ago?

Thanks again for the detail Martin. The OPUS letter was in my email of the 12th July - I just wanted to get your take on reading between the lines and what it actually means in plain english! When you have a moment that would be appreciated!
