Hello Guys,

 

I was involved in a minor accident on the Friday. The problem was that this Van was packing on a double yellow line right at the junction. I was coming from one of the road which is Lewin terrace to join the road he was packing at.

 

The van was obscuring my view, but I can still see both side of the road. As I was driving round the Van adn I was on the road where he packing, he was reversing back his car at the same time to go and pick up some school children. So, at this time he hit my car with a minor scratch on both our cars. He took the picture of me car, and I took his at as well. This guy did not wait for the Police to arrived and he drove off.

 

The police came and I explained what happened. I am waiting to hear from them.

 

I contacted my insurance, and I was told that he was already established himself on that Road, so it is going to be my fault. I told them that I was already on that road too before he started revising his car. the lady spoke to his manager, and told me that it is going to be 50/50 thing. He also told me that it is not going to count whether the Van was on a double yellow line or not. That they are only looking for duty of care.

 

I have got a third party insurance. I am not looking to claim anything, but I am wondering if my insurance premium will go up if he claims something. Is true that this Van will get away even he was packing on a double yellow line waiting there ? I have got a witness that he was packing on a double yellow line as he even insulted this woman.

 

Can someone advise me on what to do next? My insurance policy will runs out in August.

Had you had a personal injury, you probably could have gone to a no win no fee (NWNF) company to make ask them to make claim for the injury and damage to your car. But many of these NWNF companies are not interested in pursuing just damage to a car, because there is not enough room for them to earn any money. My instincts are that the accident will be either be no fault on your part or 50/50. This is based on the other car reversing into you.

 

The parked van may have contributed to the accident happening, but they may be allowed to park on double yellows, if they are unloading.

 

As you are not covered for damage to your car under your own policy, you would need to make a claim for the damage directly to the third parties Insurers. If the third party driver makes a claim against your Insurance, then yes you will lose some no claims discount and your premium will increase from renewal.

 

As this was reported to the Police, see if they can help you with the third parties Insurance details and why they drove off after the accident. Then look to make a claim against the third parties Insurance. You might as well do this, if the third party is going to make a claim against your policy.

Why would a solicitors firm take on a small claim when they will not get paid for the work done? Would you work for free?

Not quite sure I follow, are you saying that solicitors should work for free?

 

Are law firms businesses or charities? How is the firm expected to pay its staff if they can't bring in costs?

 

Strange logic if you ask me.

I agree with you. My previous point was that they advertise themselves as accident management companies, so some people might believe that they will deal with all claims.

Speak to the Police who attended the scene. Ask them about the other driver leaving the scene of an accident, without leaving their details. See if the Police will provide you with the other drivers Insurance details, if you have their reg no.
