      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thank you so much DX just need help along the way. Lacking in confidence I think but I'll get there was like this when I did my sons Bank Charges but with help from here got 10K refunded. So onwards & upwards Thanks again

Is it usual to have a completely seperate form for PPI.

 

The Form "Protection Plan Application Form " looks a bit different to that of other peoples.

 

Is this a clear case of the broker acting as an agent??

 

Sorry if I'm being a pain just getting plan of action together for fight.:oops:

About iGroup

 

 

Just found this on a loans website .

 

If they only sell through intermediaries they are definately acting as their agents may be of use to other Caggers I thought !!!

Well here goes.

 

Phoned and spoke to GE.

 

No luck at all clearly state that we need to claim against broker .

 

I also asked why they did not refund part payment against first mortgage paid early

answer the customer should have cancelled to claim a refund from the underwriter.

 

There is absolutely no paperwork re Signa.

 

How can they say that the client not aware of PPi,can claim from underwriter.

 

The form for PPI was clearly stated Payment Protection Application IG Group (Copy is in earlier post) .

 

I stated that Broker would be acting as an Agent for Ig but the response was that there was no agent agreement.

 

When I asked why does the broker have these forms he stated that IG send them to brokers.

 

I also asked why when the customer was having difficulty paying at one time and spoke to GE why he was not advised that PPI was available

 

His words were " I can make no comment on that "

 

so what next the broker is no longer trading.

thats the trouble in using the phone

 

they'll fob you off

 

you need to do this in WRITING so you have a data trail.

 

next stop is the FOS me thinks

 

but first you need it in writing that GE are palming you off

with the old broker dodge

when it was them you paid.

I have every intention of writing to them confirming the details of the call and adding a few responses and also requesting their immediate response.

 

The problem is the broker is no longer trading and the form says Protection Plan Application Form Ig Group.

 

There is nothing on the Easy Loans Application re PPI.

 

The credit Agreement States not regulated under CCA does that make a diiference.

 

I also have a copy of an underwriting sheet which gives the brokers name as Sterling Direct which I believe are one and the same as Easy Lons.

 

There is absolutely no paperwork at all which mentions Signa .

 

What I am hoping is that the for being an application form is their responsibilty to advise the client.

 

Are think this is going to be a nightmare.

Well another letter received from GE today

saying that as they haven't received any further information since their final response

advising me to go to the brokers(who is no longer trading)

 

they're now advising me to go to the Finance Leasing Association.

 

They didn't mention the phone call but today before I saw this letter I faxed and posted recorded a 3 page letter and 13 pages of stuff to back up my Friends claim.

 

Still nothing on the other account.

 

I only ever receive letters re the remortgage and they are both the same except for price charged.

 

I think somebody today will have a lot of sorting to do as I sent a batch of 7 queries and added a few more remarks.

 

a waiting game again.

 

Really is useful all of and interesting and keeping the old brain active.

 

I have a lot of friends who are all requesting my help.

 

I suppose they think being a pensioner I have more time

 

I still work 4 days a week but its like a drug now and better than knitting !!!

Well 5 Letters received today

 

1 dated 4th Sept. Re PPI On new house

States ref number and advises me to contact Easy Loans. and quotes the Underwriter being Cigna.

 

2) Dated 30th August same claim but new Reference Number and thanking me for my letter dated 27th August and that they will look at my concerns and get back to me by 24th October.

 

3) Duplicate of number 2.

 

4) Letter dated 30th August re PPI on Remortgage and quoting a new reference and looking into my concerns and will get back to me by 24th October

 

5) Duplicate of 4 .

 

What an absolute mess so in effect they have started the process again and taking another 8 weeks !!!!

Love writing letters these people another one this morning re the PPI on the remortgage. saying I need to go to Easy Loans. Would it be best if send a claim to London Scottish Bank as this is from Nov2002 I'm not sure what my next course of action will be ??

Any Advice please .

 

GE didn't respond to any of the issues I raised should I send another letter.

 

I requested a copy of the policy as proof that it ever existed but absiolutely nothing.

 

I note that the administrators of Loans.co.uk paid out I'm wondering if that would happen with London Scottish ?? HELP !!!

Well spoke to London Scottish all their brokers in liquidation so no chance with them just need to keep pushing with GE so need some help as to what to do next do I go to FSO . I think I may have exhausted what I have with GE

Without reading the whole thread, which broker did you use?

 

You could try and find the administrators of that broker.

 

If not then a call to fos may be useful as they may have some info but you might end up going to the underwriter.

The broker was easy loans who are in liquidation so no hope there.

I still find it odd that the payment protection forms were for IGroup and the easy loans forms had no ticks in the PPI box .

 

It appears that the broker had spoken to I Group and they had made the signing of the forms a condition of the mortgage being granted..

 

Even the payment was made to IGroup financial Services.

 

the underwriter was never mentioned until I called them and was advised that it was Cigna on the remortgage still haven't got a clue ofn the other one.

 

Never seen a policy or received anything.

 

I have requested a copy of the policy from GE but nothing as yet.

 

So will take your advice and have a word with FOS tomorrow

copies of the forms are in number 59 of my thread.

 

The mortgage form was in the name of Easy Loans.

 

But the PPI was on seperate forms in the name of I Group

 

this is what I'm finding a bit odd.

 

The forms were actually titled payment plan application form and were in the name of I Group.

 

The actual fee for the PPI was paid to Igroup financial Services.

 

There has never been any mention of Cignsa until I phoned them

 

no Policy or anything relating to PPI has ever been received.

 

I have requested a copy of bothe policies from GE but nothing ever transpires.

 

they just keep sending letters advising me to go to Easy Loans.

 

I sent yet another letter today requesting a response to the points I had raised and again asking for a copy of the policuy as proof it ever existed.

 

I just don't know where to turn now.

 

I will call FOS tomorrow.

 

these total over £17k and thats just the single premium added to loans one of which is still being paid and expired in 2007 !!!
