Ok dx I am going on the MCOL site and applying to have the judgment set aside. It is asking me to "summarise the reasons why you feel the Judgment should be set aside". Can you please help me word this correctly? I am asking for it to be set aside because I believe the debt was already SB, correct?

 

Are there any other reasons I should put as to why I think it should be SB?

 

Is that possible through MCOL LilMiss ?

Yes it seems to be an option still available on the website. I haven't completed it yet as I was unsure what to put.

I have just spoken to Santander to see if I could find out when the last payment was made on the Abbey acount,

but because I cannot remember address at the time in question,

she was unable to complete the security part and therefore couldn't help me.

She has told me to take some ID into a Santander branch and ask them to phone the Collections Dept

(which is where I was put through to just now)

and they can verify my ID and can find out the info I need.

To set a side a judgment you must file an N244 with the £255 fee.....to the court that issued judgment.....you cant request this through MCOL.

We could do with some help from you.

After further chatting with andy, it seems I CAN proceed with this on the MCOl website.

I'm stuck on this section if anyone (dx) can help?

I've been in hospital for a week with a very violent migraine. I'm back home now and exhausted.

 

I have had a long think about this situation and I think it's better to just pay it.

 

My question to you lovely people is this,

can I contact the solicitors and make them an offer to pay monthly, say £100 or something like that?

Or do I have to contact the court and ask them? x

Ok I've got my SAR ready to send, is this the correct address to send it to?

I found this address using the Data ProtectionPublic Register, which I found on the Full Subject Access Required page.

Received the following letter today:

Thank you for your recent request. 

Having conducted a search of our records I have been unable to locate any customer by the name and address supplied.

Consequently, I believe that you either did not have an account with us or alternatively your account closed more than six years ago.

Please note that our company deals only with Motor Finance and therefore if your request relates to another type of Santander facility you should refer to that relevant business. 

As a consequence, we are unable to provide any information. 

I have enclosed your letter and postal order, in the condition it was delivered to us by Royal Mail 

The letter and postal order have been damaged quite a bit, looks like a dog has taken a chunk out of them.

Should I go to like the CAB or someone like that and ask for their help? I just make mistakes.

Didn't do the defence thing online because I didn't realise I had to.

Sent the SAR to what I thought was a Santander general address,

turned out to be the motor finance department.

I feel like a fish out of water.

It is getting me REALLY down :(

I finally got the SAR sent off to the correct place and have today received the following letter:

Re - Data Protection Act 1998 Information Request 

I write with reference to your recent correspondence requesting information. 

Please note the information you have provided does not match those we hold on file and therefore, I am unable to comply with your request at this time. 

In order for us to provide these documents we require details of any previous addresses and names. 

I am sorry I am unable to assist this time, please note any future correspondence should be sent to the address stated above. 

If you have any questions at all, please call us on the number above. 

I did provide them with the account number and sort number in question and provided my original surname as well as my current surname. I cannot provide addresses because I do not know what they are :(

why don't you know the address where you lived at the time of the account take out?

I can sort of remember partial addresses, but I have no idea when I lived at them.

I am going to speak with my Mum later and see if she can shed any light on it.

If she can help me then I am going to ring the lady at Santander

who sent me the letter and just explain my situation to her.

yes no harm in ringing

your case is somewhat unique

with you medical issues.

one thing that springs to mind is obv your treatment

if your medical treatment was around that time, poss those medical records/letters will give you the answer?

cant see how a bank can expect people to answer a question almost 20yrs late

that most couldn't and you certainly cant due medical issues.

I have phoned Santander and explained my situation

gave them a possible address for where I was living in 1999

and their response was simply to "put it in writing".

I asked her if I could speak with someone over the phone regarding this

and she said "unfortunately no, it needs to be put in writing".
