Ok so their statement now go right up to the point where they sold the account.

 

You should now be able to complete your reconciliation between your records, those of Control Account and those of BCT.

 

What is still puzzling is whether there was actually a money judgement at all.

Debt purchasing doesn't involve the exchange of the actual agreement....they is generally a large portfolio of debts transferred with only very basic information such as names, addresses, contact numbers, amounts and account numbers.

just shows you how inept they are.

 

if they even knew or were the originators of the CCJ

 

they'd write back stating we don't need a CCA to enforce this.

 

usual rubbish

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

Well normally if they cannot supply then it cannot be enforced in court.

 

However, in this case there may be a judgement already (although it seems that there is some uncertainty).

 

A CCJ would effectively replace the agreement and there would be no obligation to provide the agreement.

 

I wonder why Lowell seem to be moving towards supplying it since they have already said that they are aware that this was the subject of legal action.

Surprised they said that, I would of thought they would of already had it since they were supposed to of brought the account.

 

 

Debts are sold as portfolio lots with the barest of information, certainly not any agreements etc.

very interesting again.

 

even if they 'do find it'

they say

they will then 'ask' for payment.

 

if there ever was a CCJ they don't need to do either!

 

just enforce it through the court.

hi dx, sorry I don't follow how do you mean punish them

dx I think is referring to the fact that if there is a CCJ in place the order of the court (judgement) completely wipes out the original agreement.

 

 

The non production of a CCA under a formal request has no penalties, the only restriction is that the debt cannot be enforced via the court.

Hi all

 

Well I've still not heard off of BCT or CC and they were sent their letters on the 1st of last month so

 

it's been 43 days now so CC have gone way over the time limit for the SAR I sent them and same for BCT so

 

what do I do now..

 

I will also add I've stopped the payments to CC today so they won't be getting anymore money from me.

 

but I would like to know where the money has gone that I have already paid them.

 

since LOWELL were sold the account,

they to have gone quiet for some reason

 

since I sent the request for the CCA.

Time to remind the of their obligations in regard to n supplying

a CCA 12 + 2 Working days and the SAR 40 days.

 

 

If no SAR is provided in the next couple of days a complaint to the ICO is in order.

Hiya Brig... Didn't there used to be a follow up letter in the library if they didn't comply with an SAR ?

 

 

Yes I believe there was.

 

 

If it's gone all you need to do is send a short note to their Data Controller,

 

 

Sir/ Madman,

 

 

Re: Subject Access Request:

Your Name

Address.

 

 

I ref to my request made under the Data Protection Act 1998 dated XX XX XXXX

 

 

The statutory 40 day time scale for compliance has now passed an xxxxxxx has failed to comply with my request.

 

 

I now require the data request within 7 days from the date here on if I do not receive the data I will make a complaint to the Information Commissioners Office without further notice.
