i myself have wondered this sinario

 

to sell an account to a third party requires a tri-partite agreement if it is not inclued in the original t&c

 

that being the creditor

debtor

and the third party company the account is being assigned to

 

ill await more comments on this one

I think, although im not 100% sure, that any creditor can sell a debt on after exhausting other methods of collection. Indeed, in the credit industry ( credit cards for example), the bank will normally write the debt off and sell it to a purchase agency for a very low price. The remainder being covered by insurance etc.

 

If the clause to sell the debt needed to be in the original contract, then it would have appeared in court cases by now and become case law.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Surely if the bank writes it off to claim on insurances and then sells the debt on this would amount to insurance fraud as both the banks and the new creditor are gaining money meaning twice the amount of the debt is being paid out in the end?

 

Surely there must be something needed in contract stating that after exhausting all avenues the company reserves the right to pass ownership of the account on. If a contract doesnt state this then where does the limit stop?

only if it had been mentioned in a defence and appealed to the crown/court of appeal or included by statute legislation amendment

 

the lower courts/county do not set precedents for case law

 

but like i said, until i know for sure ill sit on the fence

 

ill have a nose at LOP 1925

I am having problems with these muppets now. I have no problem with them trying to phone a number I have blocked on my mobile, I have no problem leaving robotic messages on my home phone. The problem I do have is leaving robotic messages at work. I found the above info, can any one verify this is the owner and address? I have now sent a second warning to them and I expect to send them a final warning BUT when I take Court action against them for their unlawful activities I would love to send it to his home address as (hopefully) he is the company director.

You need to address it to Robert Sands the compliance director. Mark it Private and confidential. Any complaint to any other address will go ignored.

 

You also MUST file a full complaint with the OFT about this company.
