Good afternoon all,

 

I have recently moved to a new flat which is on a private road and the landlord has employed CPS Enforcement of Somerset to control unauthorised parking.

I have never lived anywhere which requires me to display a permit and on one occasion I unfortunately forget to display it. I would like to add that I was parked in front of my garage on my own off road drive way and the ticket is time stamped at 01:59AM.

 

I don't know whether being on my drive way has any bearing on having to pay it but I have now passed the 7 day payment time that allows for a discounted settlement and the fine now stands at £90 for another 7 days before being escalated to debt collection and a court application.

 

I have read about ignoring these idiots, and I would appreciate any advice you may have. The time of the ticket concerns me I work shifts and my girlfriend feels quite uncomfortable about the fact that these people could be loitering around at 2AM.

 

The sign displayed upon entrance to the road is attached to a lamp post and is unreadable from the car and well above eye level if on foot.

Also, I am a bit concerned that if I don't pay it are they likely to return and clamp my car? I commute quite a distance everyday so if I get clamped I'm stuffed for getting to work..

Its not a fine as they can only be given out by police and courts, etc.

 

It is a penalty charge, most of the time these are not payable and any compnay would have trouble persuading a court otherwise.

 

Is the permit now on your car, if so, I veryt much doubtn whether it could now be clamped.

 

I'm sure someone will be along to offer more help.

It's not even a penalty charge. It is a request for payment of an invoice you do not owe them. No court would even entertain it, but then again, these cowboys won't go anywhere near a court. They cannot return and clamp if you don't pay them; if they tried that you could lawfully cut the clamp off (it is a trespass on your property) and sue them and, more significantly, the Landlord for any losses.

 

I would suggest that you have strong words with the Landlord or whoever contracted these parasites, and remind them that under standard Principal/Agent law they will be held responsible for anything the monkeys do.
