so could someone tell me 'what was the deal with kissick v citibank, why are they using it. and in ref to earlier post about the 30 days notice to change our terms and conditions, do i understand that this in refering to the terms and conditions of original credit card agreement ?, as they did send me notice that the charges would be lowered to £12 !!

judging by recent posts they really are pushing us to the wire !!

They may have told you that future charges would be lowered to 12.00 but I bet they did not say that all charges already paid would be lowered to 12.00?

They`ve requested copies of all correspondence to support my complaint.

 

As such you`d imagine that copies of previous letters would be OK. After all its not as if i`m a large financial institution sending out sensitive statements to the wrong people.

lastes letter arrived from Brian Smith today

 

i act on behalf of citi financial europe plc and write furth to your letter of 1st october.

contary to your inference, my client did not make you an 'offer' which you could decline. it made you an ex-gratia refund to your account and raised a cheque. it did this in conformity with its interpretation of the OFT reports's requirement.

my client's position is clear. it will not be refunding any further monies whatsoever and will be relying upon its recent successful defence in an identical case in northern ireland in which the court dismissed the claim

 

the above from brian smith yet i am also getting letters from Mr David travis ?

do they know 2 of them are sending out stuff ??

 

i have actually spoke to citi about a missed payment last nite, for £11, i have not had statement, but they told me i should check, but i have had a £12 charge applied, so i have asked them to send me the break down of the charge, then i was told no its a penalty, i asked is it not disporportionate?, and the reply was yes, and then i was freely told its due to the 'financial ombudsmans ruling?, i said do you not mean the OFT , no was the reply? very strange, but anyway eventually this bloke got real nasty, after i kept asking for the penalty break down to be sent to me, he suddenly said 'well if you don't like it Mr ****** then you can close the account, !!!!

so , i am afraid, i lost it at that point, several rude words came out.

since tried to ring but now account has been blocked, yet its in credit??

i think their customer advisors are having calls and they just dont know how to handle it:confused:

Wow that is good news. Ex -gratia meaning without legal compulsion or a favour or gift. Which therefore has no legal effect upon your contractual terms. According to the terms of your contract the charges you have paid still stand at 25.00. Therefore you can still claim the full amount.

 

In fact if they are claiming this isn't in partial settlement but merely a gift you can go on to reclaim it again if you so wish!!!

 

As for relying on a small claims case, it doesn't really stand up to the House of Lords precedents and statutes you are relying on.

 

 

Talk about tying themselves up in knots. lol

Reading “sharman24” post on the itiC thread, its sprung to mind that the call centre doesn`t seem to know what the legal department are doing.

 

Wonder if it would be worth phoning up Citi Cards customer services with a few account related enquiries, then slipping in the question as to whether it “really cost them £12 to process a late payment, as it doesn`t seem fair”.

 

If their response is interesting, continue with a few account questions, thank them for their time and say that you`d like to send in a letter of commendation because they have been extremely helpful – “other call centres i`ve experienced recently have been a nightmare”. That way you`ll get the persons name and most likely department.

 

Would do it myself but i`m probably flagged as proceeding with legal action.

9.1 Citi Flex Payments Monthly Instalment (to be applied to each Citi Flex Payment facility in the order of creation);

9.2 other interest and Account Charges;

9.3 existing Promotional Balances that attract a lower rate – in the order in which they were debited to your Account as shown on the monthly statement;

9.4 existing Purchase balances and non-promotional Balance Transfers – in the order in which they were debited to your Account as shown on the monthly statement;

9.5 existing Cash balances shown on the last monthly and/or previous statements – in the order in which they were debited to your Account as shown on the monthly statement;

9.6 new Promotional Balances that attract a lower rate – in the order in which they were debited to your Account as shown on the monthly statement;

9.7 new Purchase balances and non-promotional Balance Transfers – in the order in which they were debited to your Account but not yet shown on the monthly statement;

Yes Keren "A" has been quite busy but expects do be able to finish the doc for you though he told me it would be Sunday,when I spoke to him last night.

 

Heard that Citi are now using NI in their defence papers they are sending out.

 

We have a very important week coming up as far as clarification is concerned.

These ppl are in for some big suprises and as you can appreciate for the moment the details cant be fully unleashed at this stage on here.

I would be suprised if it would have any relevance tho......they have no organised structure and change thing to suit themselves.

 

If there was ever a set procedure of them dealing with claims then I have never seen it......and dont think they would be capable of keeping to one anyway!:rolleyes:
