I believe Natwest have sold to a debt collector, an overdraft and a loan i had with them.

 

I (and the FOS) asked for a copy of the loan agreement.

 

Initially they said they had not got a "true copy" but later found one, signed by me.

 

The copy they sent is exactly the same as the original I have... but mine is not signed.

Where do I stand?

I am only doing this because after 3 years with the FOS in a dispute with Natwest (unrelated)

the FOS found in my favour and awarded £1000 for stress etc

this level of compensation is classed as exceptional on the FOS website)

but my financial losses are probably £50k,

and the FOS did not award compensation for losses.

Hi there. The fact that yours isn't signed wouldn't realkly make a great deal of difference. The key is whether or not the creditor holds an agreement that has been signed (i.e executed) by you.

 

There could, however, be other issues worth looking in to. When did you take the agreement out? Also, can you post a copy up here minus any personal info + barcodes etc.

Hi. Thanks for that. Yes theirs is signed, but they have copies of my signiture as I did bank with them. My copy is the actual original, even the crosses put on where to sign are the same, its just that my original (not copy, and all parts) is not signed.

cant read postage stamps

 

scan the required letters/agreements/sheets

as a picture[jpg] file

remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

 

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf

than many single ones

or if you have PDF as an installed printer drive use that

or use word and save as pdf

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

then hit reply button

I think it was June 2007

 

For agreements taken out after 6th April 2007 the rules changed quite significantly. You may find it very tricky to challenge the enforceability of the agreement - especially in realtion to signatures and things.
