Hello

Can anyone tell if there was any Rullings or banking code

that says Banks must consider customers hardship before claiming 'breach' of Credit Card Agreement ??

as I stopped paying them becuase they took me off the previouse hardship lower repayment plan

without any consultation with me, or reviewing my finanical situation - which was still very bad.

They were charging me 23% interest I could not afford !

They are taking me to court now - without considering my hardship situation created by 23% interest applied.

Hi seek

The Lending Code which has been around for quite a long time would of covered that, find the Code for the relevant year.

This isn't specifically about 'Hardship', but rather that Consumers should be treated 'fairly'.

e.g. :- http://www.lendingstandardsboard.org.uk/docs/lendingcode.pdf

I think you need to scroll down to Section 9 of the Lending Code for all the information you require :)
