It looks like I'll be taking Comet to the small claims court.

 

1. cooker broke after 13 monts

2. comet refused to repair / replace

3. got an electrician's report stating the fault was 'with the appliance'

4. comet still refused

5. just about to send my final letter (attached)

 

.... then to court!

 

Any advice / reassurance gratefully received!

Looks as if you are doing everything correctly.

 

Presumably you have an estimate for the cost of repair. You have had 13 months use so you won't be able to get a replacement but you will be able to sue for the cost of repairs PLUS a discretionary sum for the loss of use of the cooker. However, it is your duty to mitigate the loss and to get the cooker repaired at your own expense and then claim the money from Comet.

 

Make sure that Comet are aware of the estimate and have been given an opportunity to make their own inspection - even if they refuse. Once they have inspected - refuse to inspect, get the cooker repaired.

 

You should also report them top Trading Standards.

 

We have had lots of stories - and I have direct experience of Comet failing in their consumer statutory duties. They are not to be trusted when it comes to customer service. They seem to be prepared to sacrifice their customers and their trading reputation in order to avoid their lawful duties.

 

They will dig their feet in but don't worry, if you have all of your documentation in order, you will win in court.

 

Don't get distracted by them. 14 days and then sue. No excuses.
