Either we have peeps who cant read English,or else they are insulting site team intelligence.

In the first case scenario,we would be happy to point to some help with study.

But in the second case,we just proceed to show that they understimated it.

This s similar with what we have been seeing with Capquest-issuing SDs as a means of debt collection-the Courts are getting pretty fed up with it.

CAG had another result last week and agreed to a set aside.

The OFT are monitoring the CO situ.

Their website is on slowdown but here is some info;

 

Why would a creditor apply for a charging order? Financial companies can apply to a court for a charging order when a consumer has failed to keep up payments on their credit card or other form of unsecured debt. The Office of Fair Trading (OFT) warns financial services of this form of enforcement actionThe number of charging orders granted by UK courts has risen from 45,000 to 164,000 over the last five years. The investigation by the OFT found a numbers of problems relating to the use charging orders by major creditors. The OFT singled out four lenders ordered to make changes to the way they operate. The problems uncovered by the OFT’S investigation were specific to each business, but across the sector they included:- A failure to consider the customer’s circumstances or proportionality before asking the court to put a charging order in place;- Not building adequate checks in to the lender’s decision-making process;- Applying substantial charges for referring cases to a debt collection agency; and- In a minority of case, sending oppressive and/or misleading correspondence.

 

The OFT’s Director of Consumer Credit, Ray Watson, said: “Our investigation uncovered instances of charging orders being used to secure debts of less than £600. Lenders are entitled to use charging orders but must do so proportionately. Where we consider the use of charging orders to be unfair or oppressive we will take action to protect consumers”.Before seeking a charging order, creditors will now need to demonstratively take account of the personal and financial circumstance of the customer, the amount that is owed and whether it can be obtained by less drastic measures.

 

‘Which?’ borrowing and debt expert Martyn Saville commented:“The OFT’S findings are worrying and are a timely reminder that even unsecured debt can put your home at risk if you fail to keep up repayments. Anybody who receives a letter from their lender threatening a charging order should seek professional debt advice as soon as possible”.

ive been dropping words for over four years about charging orders BA and i could nt get there attention oft that i,s i also sent notices to FSA at same time ,all i ever got back was there terms and conditions , i really think its a Police Matter as it is a bit on the unlawful side hoodwinking judges etc

i would love to know just how many charging orders they have managed to obtain surely the court system ought to be contacting these people with regards to a stay and a return of funds

The OFT have done some sterling work over last 18 months.

We know they are overstretched.

Likewise the FOS-who admitted that stalling banks forcing them to drag them through the Courts for bank charges and then PPI,have drained them.

I reckon there will be figures somewhere accessible for the CO's they have applied for.

I am not too sure if a FOI request would not get you this.

Depending of course on getting the wording right.

Hmm if the OFT can get the data to produce the number of enforcement actions taken on consumer debts then they must be collating the information somehow... can the OFT be FOI'd?

i did the FSA and OFT under the FOI they both declined to answer ,through whatdotheyknow that was over two years ago ,but at least they are onto them..but how much they want to know we shall see in the fullness of time i guess,

i am also awaiting the oft and fsa with my complaint against alice that's been well over two years ,but my complaint was double barrelled as i was also complaining about Experian for making available false information supplied by Alice and DiDI ,exper refused to remove the Data because Alice and DIDI said it was all above board and i was to go to them to have the Data removed ,i have the letter here from DIDI explaining they were within their rights and as soon as i paid they would allow the defaults to lapse in the fullness of time , thankfully after advice from donki BA and VJ i got in touch with the director of barclays and had it removed immediately ,anyway lets hope he gets the stripey uniform soon ,

If I was doing this I would do the FOI to the MOJ-since its more up their street.

The FOS and OFT are not gonna give this stuff.

If it looks targetted maybe the MOJ too could take issues.

I would try and make it an open request that didnt give the reasons away.

Maybe ask for the list of all of em.

That actually would prob be easier for them in scope.

I have done a few FOI myself,the secret of getting what you want is not giving them any incling of the agenda behind it.

so make it wide -it just means you having to do a bit of homework picking out the bits you need when they comply.
