now i'm on the verge of a complete mental breakdown and it's causing my son great distress and my daughter who's only 7 says she feels worried about mummy and who will look after her if i become to sick!!

@jadeybags-hello, just thought I'd update on developments. Tax credis say I have an overpayment of £12,000!!!:sad: They say they believe my partner is still living here (prob cos his post still comes here- and the joint account. But I dont know what to do cos he's been abroad since 2009 and he isnt physically here. They've stopped my payments and say that they called his employers and confrimed that he's been working until Jan 2011:x! not possible, cos he's not here- how do i prove this? I've written to them to investigate further and challenged the overpayment. in the meantime, i'm skint!!

It isn't just about where he physically lives, tey also need to consider if you are geographically or maritally separated.

e.g a couple where one is serving abroad in the armed forces are geographically separated not maritally separated.
