Hi, no you don't need to take anything else - you could take proof of income and keep it in your handbag - it's very unlikely that the judge would ask for it.

 

If at all possible it would be best to get the form to court tomorrow just to give yourself a bit more time to get the hearing.

 

Let us know when you have a date for the hearing and we can go over the process.

Form is with the court and £35 paid. They didn't give me a day or time then, but said I would be notified by phone ! So just waiting on tenderhooks now. I'll let you know as soon as I hear anything.

Did you actually speak to the court staff when you took it in? they usually can tell you when the hearing will be while you are there?

Yes I did and I asked questions about what would happen ! Maybe it was the fact that George Micheal was due in the same court that day !!

Apparently he was due t appeal yesturday so they were geared up for it and it got cancelled at the last minute !!

Hmm, and as usual the general public have to step aside because some celebrity is having problems ! Hopefully they will ring you on Monday morning - if they haven't rung by 11 you should call them to see what's happening.

Just heard from the court and our hearing is 2pm tomorow (Tues) Apparently, I've got the eviction date wrong and it's for wednesday !!

 

What will happen on the day ? I am so scared I feel really sick. and I have another problem. My partner (who hasn't been very well) has now developed some sort of bug. He's not going to be fit to make it tomorow. Is this a problem-or can I go on my own ?

Hi there, you can go on your own - it won't be a problem. Ring the court and ask if there are any legal advisors at court tomorrow i.e. Citizen's advice or housing charity ones. Lots of courts have them these days and they can accompany you into the hearing and support you (or speak for you). I will be back online later tonight when I get home from work and will go over the process with you - I just logged on quickly from work to see if there was any news on your hearing.

I'm normally such an "in control" sort of person, and don't really panic too much. I'm used to standing up in front of hundreds of people to do presentations etc.....but this is really scaring the life out of me. If it weren't for your support I don't know what I'd do..........so Thankyou again

Hi, did you manage to find out if the court has any legal advisors there tomorrow?

 

You should arrive at the court in plenty of time. If there are any free legal representatives there, approach them and ask for their advice. They can accompany you into the hearing if you wish and speak for you. Sometimes the representative for the other side will ask to speak to you, it is up to you whether you do or not. If you do, and you feel intimidated at any time, just end the conversation by saying you would rather wait for the judge to decide.

The hearing will take place in a private room with just the judge, you and a representative from the other side. It is usually conducted around a table, like a meeting. The public are not admitted.

As it is your application for a hearing the judge will speak to you first - he(or she) will know that you are nervous and they are usually very good at guiding you through the process. If you have to address the judge it should be Sir or Madam – and don't interrupt them when they are speaking!. The whole procedure should take no more than 5 or 10 minutes.

Well I just got back. Only 3 cases listed, but mine was last and the others took nearly 1/2 an hour each. SPML's solicitor did approach me and wanted to talk, but I have to say that anyone listening would think he was working for me. He told me that SPML had already rejected what I had offered and would not except anything other than my soul, so I should stick with what I had put down. He even said the Judge always favoured people like me, so not to worry. He talked me through the process, gave me advice and told me not to worry !!!! Really strange !. Anyway, Ellen, you were right. The judge was more than happy to suspend the eviction as it was clear I had may significant payments for over 12 months and he was happy to set the arrears at £250 per month as there was more than enough time for it to be paid during the remainder of the mortgage. Their solicitor even told me that I should go back to court if my circumstances change and I need to have the extra payment reduced. The judge didn't speak to me once, and I felt a bit redundant !!! The only setback was the fact that they have cancelled my agreed payment date of 15th (after I get paid) and it has reverted back to the 1st of the month !! So I have to find the first payment before I get paid in October.

Did the judge state the payments were to be made on 1st of the month? if so, wait for the order to come through in writing from the court - it will have the date the first payment under the order is to be made.
