I've been given a PCN for being "Parked in a restricted street during prescribed hours". The road in question is marked with a single yellow line, however when I looked along the length of the line I couldn't see a parking restriction sign. The evidence that has been provided by the council shows that the parking restriction sign was in fact a sticker which was stuck to a lamp post (see photo: farm6.static.flickr.com/5096/5510168208_05c5a10b15_o.jpg )

 

Is this a valid piece of signage? I've had a read through the Traffic Signs Regulations and General Directions 2002, and it seems to be quite particular in its use of the word "plate" when referring to signage, which this sign clearly isn't.

 

Any advice greatly appreciated.

@diskmandave - Thanks for providing a link to my image.

 

@Jamberson - That's my gut feeling as well. I can't find any specific regulations as to what constitutes a "plate", so I think it would come down to a judgement call as to whether the sign is clearly visible. Obviously I don't think it is as I didn't see it, and to my mind it feels almost deliberately sneaky.

You could argue that it's possible to miss it completely, as you don't expect to be looking at stickers on lampposts for direction. Not all single yellows need plates, so you might assume there wasn't one there, unless you looked closely.

Unclear signage is not one of the statutory grounds for appeal. You have to fit your appeal into one of those. In your shoes I would tick the "contravention did not occur" and the "penalty exceeds the applicable amount" boxes on the NTO.
