My overdraft with Smile is currently £700. Of this, £337.22 is charges. They have refunded £225 (apart from the £337) so far but won't budge now.

 

They are harassing me into paying back the balance which I have agreed to do at £20 per month.

 

I wrote to them 2 weeks ago with a basic letter detailing the list of charges I want refunded and said that I felt a mutual agreement was fair in that I pay £50 p/m and they remove the charges.

 

They wrote to me today and said "after careful consideration":rolleyes: they are taking the offer of £50 p/m repayments but "your request for a refund of other charges has been declined":evil:

 

What I am hoping you guys can answer is, is there any point in me now sending the preliminary letter in the library, or should I just go straight for stage 2?

The Pre Lim letter has a wide ranged explanation of laws and terms in it that they should really recieve before taking them to court. Only so they can't kick up a stink saying you didn't give them enough time to pay up. I would personally stick to the times and letters in the templates library but the rest is all up to you.
