You only have to send one CCA request, anyone else who chases it should get a letter saying this is already in dispute with xxx and has been since yyyy, send a copy of the original request. There is a template letter in the library to use for this.

 

Which DCA is ringing your son?

 

Report them to Consumer Direct and OFT

What has been happening when your son has been rung? Is he

 

a) ig noring it

b) telling them to F off

c) telling them he doesn't know who you are

d) telling them he knows who you are

 

Arguably if he is just puttingnot picking up the phone then they can keep ringing - because technically they haven't got an answer.

 

If he has told them once that he doesn't know your or he has told them he does know you then they shouldn't keep calling him. Report it, but log all the dates and times of the calls and keep them in the phones memory.

A huge portion of the amounts they claim owing are from charges but I'm having a job to get the figures from them as it's some 10 years ago now (I was paying DCAs nominal amounts for years).

The DCA ringing is APEX - they were not able to produce a copy of the CCA. My son told them the first time they rang that this I was his mother and this was not my number. Since then he ignores their calls but knows it's them as they always follow up with a text asking me to get in touch. I will write to them direct and report them also as suggested. Thankyou.

Another DCA - Link - are threatening to add 'something' to my credit file if I don't pay up. I have had SAR data from mbna and found serious irregularities in the PPI and mbna say they are 'investigating'. However Link, despite my writing to them to explain this are saying the PPI has nothing to do with them and the money is due to them, and the latest was the other day where they say they will reflect my non payment in the credit file As this is another old debt (1998/2001) it is not on my record - can they do this - can they put stuff on my credit record re this debt now and while I'm disputing it with mbna?

If you have been paying without your sons knowledge or agreement, these old debts would be statute barred, so you could stop paying them. That could be one way to play this.

Phoning your son is out of order you have to write to them and demand that they

remove all details from their records forthwith and all contact must be in writing.

Yes put the account into dispute.

If you ut the accounts in dispute for non-compliance of legal requests then the dcas will have to stop chasing. If they do not desist then you just report them to all authorities you can think of and do not have to deal with them.

 

Account in dispute so ok mr dca......see you in court then

Agreed, just make sure you keep all correspondence and keep a time and date record of any calls.

Ah I see. I think DCA's must have searched for people having tel numbers registered to your address. Yes make a complaint. This is against OFT rules for them to make contact via a third party.

Reports to OFT and trading standards for a start and if they attempt to discuss any thing with your son this must be reported to the Information Commissioners Office

Hi all, we had a visit from a doorstep dca recently which I believe was from Lloyds. Following their SAR I wrote to them to complain that they had neglected to send us relevant data. We received a reply to say that as the account relates to 1998 all system data are no longer held. Also they are unable to provide copies of the original card app forms or statements due to the time. Also they cannot find any evidence that ppi was paid and if I believe this was I am to supply details. I don't think I have this evidence anywhere either.

I would be grateful as to advice for next step please.

Hi Pru, the general picture is when creditors

have ''problem'' accounts they sell them of on blocks

and provide the debt purchase companies with

the minimum of detail, and for pennies in the pound.

Thanks Brig. DCA's are demanding thick and fast, including a doorstep collection a cpl of weeks ago. We would certainly agree to pay a just & fair amount but I know that definitely a huge amount of that owing (about £2600 is the total they demand) was their exorbitant charges! Lloyds are unable to supply proper details of the accounts (see #24 above) - shall I write to Lloyds and all DCA's saying that as they are unable to show me the figures they are demanding, etc. Any help with a letter or suggestion as what to do next would be much appreciated! You mentioned earlier that you had received a reply to your SAR.

 

What did they actually provide?

 

Lately, lloyds seem to putting up this screen that they don't have data over six years old "due to time". Now, its up to you of course but I would challenge them on this. I would write to them and say that they are in breach o the DPA and if you do not receive ALL of the information you have requested you will be reporting them and their data controller to the ICO.

 

In addition I would tell them that you you will also consider court action to force compliance and in that action you will naming their data controller and will also seek damages at the court's discretion.
