I have my letter all drafted, concerning the microfiche issue. Am confused where as to send to, the address my letter came from was,

Hi, when i sent my reply, i sent it to the Milton Keynes address. After all, when you sent your SAR letter to that address, they got it. Personally, i don't like sending letters to PO Box address- at least, not important ones!

Hi all,

 

I have now received 13 months of statements and am waiting on my reply from abbey to the microfiche argument , letter sent in response recorded delivery.

Now down to waiting for the 40 days to be up, 4th october.

Should i be preparing my spreadsheets with statements i have received so far?

After receiving 13 months of statements and the microfiche letter, I sent the letter in reply.

This morning I received the following letter, Please could someone advise. Also I would like to know exactly to which address I should send my letters.

One of my team will be responsible for investigating your complaint and I have enclose~d our Complaints leaflet, which explains our procedure for doing this. High quality customer service is of great importance to us at Abbey and we will do everything we can to resolve your complaint in a timely and satisfactory manner.

I know it is important to you that we resolve your complaint quickly, but we want to do a thorough investigation and sometimes this can take time. If we have not contacted you before then, we will write to you in four weeks to let you know what is happening.

Although I do not know what the outcome will be, I do hope that we will be able to find a solution that you are happy with.

I dont think they have any mechanism for dealing with being sued by their customer for some reason :-)

I wouldn't be too harsh on Abbey - the Financial Services Authority says they have to treat any "expression of dissatisfaction" as a complaint, and lays down a complaints framework all banks have to follow. This is why anyone who writes in about charges is treated as though they have complained - because if they didn't Abbey or any other bank would be in lots of trouble with the FSA.

Please somebody help???

When I sent my 1st letter of request for statements I didn't enclose £10. Which I now realise that I should of, but I was getting conflicting advice at the time. I received a letter from abbey, with the Authorisation request for DPA Transaction request form, but again I had conflicting advice and was told just to wait. I have since received 13 months of statements. As I am now getting near to the end of 40 days and have been scouring all threads, double checking, I now realise that I should possibly of enclosed £10 to abbey. Is it now too late to send the form with money or do I now need to start the whole process again.

I really am in such a turmoil, please, please could anybody help.

I agree with what you say, but with it they enclosed the form for me to fill in and send £10 with, copy below.

 

 

Thank you for your letter dated xxxxxxxx which we received onxxxxxxxxxxx, requesting information on your bank account.

I would like to advise you that under a Data Protection Act Request, you will only receive the transactions that are currently held on our systems. These will be forwarded to you within 40 days, free of charge, under separate cover. Any earlier transactions have been archived onto microfiche, which is not covered by the Data Protection Act. These archived transactions will not therefore be supplied to you under a Data Protection Act request and will not be subject to the 40 day ruling.

Unfortunately, we are unable to supply a list of charges applied to your account for the last six years because we do not store this information separately from other transactional data. We can only supply a list of the transactions on your account, which will include details of any charges applied.

We can however supply details of the transactions held on the microfiche on payment of an administration fee. The fee is as follows: -

£5.00 for 1 monthly statement that has been archived

£10.00 for multiple monthly statements that have been archived.

that's the standard microfiche letter..Abbey's way of delaying your full data...there's plenty of threads on how to deal with the microfiche argument...standard stuff.. They have accepted your DPA by providing you with what they think is relevent DPA info. Proceed as normal and don't worry about the £10

Does this mean that you ignore the letter and send off the prelimanary letter?

Abbey are contradicting themselves bigtime here - they say that Microfiche aren't covered by Data Protection Act, yet at the same time ask you to fill in a form headed 'Authorisation Request for Data Protection Act Transaction Statement'. Bearing in mind that they have already supplied you with the Data that isn't on microfiche, I would take this as an admission by Abbey that their microfiche records are indeed covered by Data Protection Act.

If you haven't got all your statements you can make an estimate of charges incurred on the staements that haven't been sent. This claim can be ammended later.
