Hi,

fairly new to the forum and completely new to the concept of reclaiming bank charges. Apologies if posting this in the wrong place but the forum is so cluttered with brightly coloured hyperlinks i'm not sure what to look at.

My situation is simple. I bought £10's worth of clothers from Next online, must have agreed to setup an account with them instead of a 1 time payment. Opted for free delivery if I took their next magazine (saved about 15p doing so :/ ). The bill came in the next month after receiving both my clothes and magazine -but only for £10. I paid it and thought nothing more about it. 6 weeks later (today) i noticed I have £30 missing from my bank account and then I see it's for a "missed direct debit" payment. As far as i could remember I didn't have any DD's on the account. Of course it turns about to be Next and the crafty feinds invoiced me £3.85 for the magazine the following month without ever notifying me. I've now promptly paid the bill and am not sure if there is anythign I can do about the £30 i've lost.

My account has always been in credit with no overdraft ever taken out. I'm currently out of work, so £30 is half a weeks money at the moment -something i really can't be without.

Any help or advice about what I can do is greatly appreciated and if there is anything I can do I'd really like to know how to proceed next.

Thanks in advance

Hi Tobal, given that this is your first problem with your account,it may well be an idea to write to your branch manager and ask them to consider refunding the charge as a goodwill gesture, given that it was unintentional and your first time.

I would also point out that you are experiencing financial difficulties and that they have a responsibility to deal sympathetically and fairly.

If you can I would take the letter in personally and ask for a reciept for it.

Make sure that you keep a copy.

If Next did not notifiy you, and I suspect there's no way they can prove that they did, then you should be covered by the direct debit guarantee. If you get nowhere with the goodwill argument then try the DD guarantee route.

I learned recently there is a lot more to the DD guarantee than the little bit companies read out to customers.

The views I express here are mere speculation based on my experience. I am not qualified nor insured to give legal advice and any action you take will be at your own risk.
