My Cheque Had Been Altered - HELP NEEDED/Malaysian Bank

Hi everyone,

 

 

I am from Malaysia.

I had did a big mistake.

I had issued a total of 22 cheques and all had been altered on the numerical number. The mistake was done because of my careless that i did not written the alphabet (represent the amount of cheque) on the cheques issued by me.

 

So, i am seeking help of all kind hearted person to teach me what should i do?

How to write a proper complain letter to Bank?

And will i get the refund back?

hi i staying at malaysia..

i seeking help and consult from all of you that expert in this banking issue...

 

i had issued 22pcs of cheque which i do not fill in the alphabet number and name of the bearer. And i only fill in the numerical number (digit).

 

so, the idiot bearer, altered my cheque issued to him by adding 1 at the front.

 

example, i issued a cheque of RM231.00

but that idiot, change it to RM1231.00...

total of 22pcs of cheque he adding 1 at the front and i only notice it when my bank statement arrived...

which is too late to stop payment...

 

so, i looking help from all of you, to teach me how to write a proper complain letter and seeking refund from the bank........

As far as I can see the bank is not responsible.

 

From what you have said you wrote out cheques with just the figure payable and left the rest blank. The payee has then added a 1 to the figure and filled in the wording to match the new figure, so that as far as the bank is concerned the wording and the figures match correctly and have processed the cheques

but can i requested bank to check the genuine of the numerical number only...

this is because the "1" that the idiot add it was totally different from my writing...

Except I'm not really sure how a cashier who has no knowledge of your writing can tell that a single downstroke ie a 1 is obviously someone else's writing. You cannot expect them to forensically examine every cheque that is banked and on cursory examination the wording matched the figures and it was your signature.

 

You need to report the payee to the police for defrauding you of RM22000.

the problem is the payee is not using his own account to cash out the cheque issued that issued to him...

he used 4 others bank account to cash out the cheque which not belong to him...

Ask the bank for the original cheques or at least photocopies which will show that they have all been filled in by the same person regardless of the payees name. Match each cheque with the appropiate invoice to show that the figure 1 has been added to each. Then go to the police.

i had all the photocopies of the 22pcs of cheque and the invoice too...

and i had filed a police report again him too...

but Malaysia's police :(.... i have no further comment as i am Malaysian...

 

so, my only hope is to get to the Bank Negara (mean Malaysia Bank which incharge of all banking rules and procedures)....

All bank (no matter oversea bank or local bank) have to report to Bank Negara at Malaysia here...

 

so, i would like your help to teach me, how to write a proper complain again the alteration of cheque issued by me which not being trace or caught by my bank

This is the Central Bank, they will merely refer you back to your own bank.

As I said before, your bank is not at fault.

 

You are focusing on the wrong target.

 

I know nothing of the Malaysian legal system. I understand there is some form of small claims court, but apparently the claims limit is RM5000

 

Have you consulted a lawyer?
