Good morning. I had a credit card with Capital One and then lost my job. I came to an agreement a number of months ago with C1 to pay them £6 a month because of my circumstances and all has been fine.

 

Today I have received a letter telling me my payment plan is up for review and giving me 30 days to submit a new income and expenditure form to them along with a copy of a letter showing the benefits I receive and how often I get them plus copies of a complete bank statement showing receipt of income and general expenses.

 

They tell me if I don't comply, they will not be able to extend the plan and will pass my details on to a debt collection agency or sell my debt to a debt purchaser They have also offered me the option of a one-off payment of less than the full amount (an option than I cannot take up as I'm out of work).

 

My question is, are they within their rights to ask for my bank statements and letters from the DSS and if I don't respond with these letters, what recourse is there? I am loathe to pass my financial and personal details about to anyone.

You have no obligation to give them the information they are asking for.

So dont do it.

Offer them a token payment of £1 per month and tell them if they dont like it

.....tough.

How old is the card, when did you take it out?

Do you remember signing an agreement or was it done online?

I know more about how to deal pre 2007 agreements than ones this new, but hopefully someone with more knowledge will be on soon to help you. At least the ball is rolling now.

I'd still write to them and tell them you are not obliged to give them that info and offer them £1 per month.

It might be helpful if you did give them a very basic I and E form, only give them what info you are comfortable giving them.

If you are on benefits Crap 1 know that they shoudn't be asking about that, they are for you to live on, not to pay them.

they have no more right to the information than i have...if you are sure the agreement you have is enforceable the most you could afford if unemployed is a pound a month..no dca is going to take you to court if you have no money coming in..it aint worth their while... you tell them what you can afford if anything
