hi jamming,

glad you are going to look at my options, i would try these myself, so can only try and help as i see it, you have been treated apallingly.

 

also you will find your mum will guide you in life, she is with you in spirit,

our family have had so many experiences with mum since she passed over, as i we were extremely close, and i know what you are going through, but trust me, there is definitely a spirit world, and until people experience it for themselves, they cannot believe, but many do, :cool:

the pain can be immense at first, but it does get better, but please believe me when i tell you, she will be with you in spirit.

i could write a book about all the things our family has experienced,

i know it is very hard dealing with anything after a loss of a loved one, these people do not understand how hard it really is, but you will find the strength, and if i think of anything else i will post it, please let me know how you get on, and post when you can an update, god bless you.

I Have only just come across your thread and am appalled with the way you have been treated.

 

I have known for some time that barclays are not at all fair in how they deal with their customers, but this goes way beyond that. You couldn't make it up.

 

I think you only have to throw doubt on barclays assertion that you are responsible for these transactions for their claims to fall around them.

 

In relation to the transactions over the counter in particular and also those taken at atm's they have cameras all over the place, so would be very easy for them to check if it was you came into the branch and carried out the withdrawal.

 

This stinks of barclays realising they are guilty as hell and have messed up big time, so deny responsibility and try to pass the buck to you. Hoping you will not challange them on this.

 

Stay strong and even if things don't go your way, you will still have options.

I'm totally lost at the moment. FOS sent me a questionnaire which has to be sent back by 9th September 2010. Today 11th September 2010 a response from FOS "Barclays is not required to refund the disputed transactions as there is insufficient evidence to show that they were unauthorised, the pattern of the withdrawals do not fit that of opportunistic fraud. No unsuccessful withdrawals were made follwing concelation of the card on 30th October 2009. Barclays has confirmed the police was investigationg the fraud claim with 'Audio Vision Direct. However this has no bearing on the outcome of its own investigation".

 

Based on the evidence provided it would be difficult to conclude that the disputed transactions were made without my authority.

 

Can this be correct? I feel totally sick at the thought of losing my money which I know nothing about.

 

The only other option I have now is to return the enclosed card received today stating I want to continue with my complaint because.............

 

Any help? I,m desperate

CCT footage was given to the police via Barclays to investigate transactions taken place at Audio Vision Direct. To date no update has been given to me. I have 21 days to contact FOS which I will be doing, but feel totally useless and lost. Not sure where to turn now

Can you chase this up with the police and see if they have identified any relevant transactions.

 

I suppose, even if they can clearly see the purchaser was NOT you, the suggestion by the bank or police may be that you were involved in the dodgy transactions.

 

I also think the police should be asked if they have any opinion about the nature of the fraudulent use of the debit card.

 

Clearly the FOS seem satisfied with Barclays' opinion about "the pattern of the withdrawals do not fit that of opportunistic fraud".

 

See if the police have a similar, or other, opinion.

 

I wonder if there's any specialist help or opinion you can get. Not from a solicitor but from a "forensic accountant" who deals with bank fraud cases. Maybe speak to some Private Investigators and see if they know of an appropriate course to follow.

 

£16,000 is a hell of a lot to lose and you may have to consider spending something to try and get it back.
