I just obtained a copy of my Equifax report as I got knocked back for a store card at Debenhams recently.

Within the report is a default from Virgin Media that they apparently served upon me at a previous address in 2007 and there is £58 outstanding??!!??

I have no knowledge of this default being served nor the debt. What can I do to get this error corrected? I am distraught because my record has this blemish on it without me knowing anything about it.

Hellllllp please.....

ELEVATED COMPLAINTS

DEAR SIR/MADAM

I REQUIRE THAT THIS MATTER BE DELT WITH BY YOUR COMPLAINTS DEPARTMENT AND A FULL RESPONSE IS REQUIRED.

ON XX/XX/XXXX I APPLIED FOR A CREDIT CARD AND WAS DECLINED. I REQUESTED FROM EQUIFAX A COPY OF MY CREDIT FILE TO SEE WHAT, IF ANY, NEGATIVE INFORMATION WAS RECORDED.

TO MY HORROR A CREDIT DEFAULT WAS RECORDED ON MY FILE BY THE VIRGIN MEDIA GROUP.

FOR YOUR REFERENCE I HAVE ENCLOSED A COPY OF THAT PART OF MY CREDIT FILE THAT LISTS THE DEFAULT ENTRY FROM VIRGIN MEDIA.

I CANNOT UNDERSTAND THIS ENTRY AS I HAVE NEVER HAD AN ACCOUNT WITH VIRGIN MEDIA.

I REQUIRE VIRGIN MEDIA TO DO A FULL INVESTIGATION INTO THIS MATTER, I ALSO REQUIRE VIRGIN MEDIA TO REMOVE THIS DEFAULT UNTIL IT HAS COMPLEATED ITS INVESTIGATIONS.

I REPEAT, I HAVE HAD NO DEALINGS WITH VIRGIN MEDIA.

I MUST ALSO INFORM YOU OF THE FOLLOWING, FOR WHICH I AM CONTEMPLATING ISSUING A CLAIM FOR DAMAGES IN THE COUNTY COURT UNDER THE DATA PROTECTION ACT 1998.

THE FACT THAT A DEFAULT HAS BEEN RECORDED WHEN THE DATA SUBJECT IS NOT THE PERSON IT REFERS TO, OPENS UP THE CREDITOR TO A DAMAGES CLAIM. THIS HAS ALLREADY BEEN DECIDED BY,

KPOHRAROR V WOOLWICH BUILDING SOCIETY (1996) 4 ALL ER 119

I AWAIT YOUR RESPONSE

SINCERLY

SEND RECORDED DELIEVERY
