I asked Cabot Financial information under the consumer credit act 1974 in march 2009.

 

i just got a letter from them dated 13th october 2009 with the information i asked for.

 

in the pack i got was also a letter from vanquis with the date on the letter 03 march 2009.

 

it says i refer to your recent request for information under section 78 of the consumer credit act in the reference to the above account.

 

i can confirm that you initially applied for one of our cards using the on-line application form 30th june 2006 at 17.28 pm.... but just as i got to the bottom of the page this what they said.......Given the above please be advised that i am therefore unable to forward a hard copy of your application....however please find enclosed a copy of the terms and conditions that were initially sent with the welcome pack and card....

 

My questions is there is no copy with a tick that says i accepted the terms and conditions

I am Means2anend.

 

it appears asthough the area of the Consumer Credit Act that deals with your 'token'(credit card) is section 14 of The Consumer Credit Act,and because you allegedly appear to have applied ON-LINE,Section 176A inserted(31/12/2004) by(Electronic Communications) Order 2004.Read this area and it speaks about what should or should not be in the signature boxes.i think this may answer your question.Also check to see whether the terms and conditions have a term that assigns the agreement over from your Original Lender(Vanquis I assume) to Cabot.This is covered by The Rights(Third Parties Contracts) Act 1999.
