I took out a loan with Alliance and Leicester in 2003 and took PPI.

However, I did this completely online, so I was totally unaware of certain things such as being able to obtain PPI from other providers, that it wouldn't cover existing illnesses, or I believ that if my employer at the time paid me full sick pay9 which they would, that they would not pay out.

 

Part way through the loan I started a DMP with CCS who advised me to cancel the PPI as it would not be valid while on the DMP. I attempted to do this but was told I couldn't unless I settle the loan with another without PPI. Obviously on a DMP this was no option at all.

 

Would I have a claim for miss selling I'm at a loss to see how online customers could claim miss selling as there is no telephone contact when taking out the loan.

A&L have been writing to lots of customers with PPI offering refunds.

Can I first ask do you still have copies of the original paperwork?

 

If you do not then you should start by sending a Subject Access request to A&L.

Data Protection Act 1998 - Subject Access Request

 

When you send the SAR you should specifically ask for these items:

 

A true copy of your Consumer Credit Agreement with the Terms and Conditions that were applicable at the time you took the loan.

 

Copies of all statements applicable to the loan.

 

Copies of all correspondence that apply to you as a data subject ie letters, emails, faxes etc.

 

Copies of all recorded telephone calls or transcripts of the recordings. (not at the point of sale in your case but since)

 

A copy of the needs and wants/ customer duty of care questionnaire... here is an example. (they will not be able to produce this for an online application so how can the be certain the product (PPI) being sold was suitable?)

Copies of any notes made by any staff in their dealings with you.

 

Online banking has so many pitfalls it puts the onus onto you to tick or untick boxes etc and inevitably there is a catch to trip you up.

 

The aim here is get as much information as you can before submitting a claim to them for mis-sold PPI.

 

There are others on this forum claiming against A&L so perhaps you can post and swap notes and get help from others in the same fight with A&L.

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

The only paperwork I have is the orignal credit agreement and the ppi agreements.

I'll make this as short and painless as possible.

I cannot remeber if I had to tick in or out for this when I did so.

At no point was I aware that PPI was available from other sources.

Nowhere in the terms and conditions did it state this either, although there was the usual cooling off period.

There was also no mention on the T&C's that I would not be eligible for payout if my employer paid full sick pay which at that time they would of.

 

Now on a DMP with CCCS who advised me to cancel due to it being no use now I was on reduced payments anyway.

Was told the only way I could do this was to refinance the loan which I was in no position to do so.

 

So my question do I have grounds to reclaim the £1700.00??

Yes even on a DMP you can claim back the PPI if it is cancelled due to a DMP etc. I am in the process of doing that but have just started so can not offer conclusive advice.

 

I would say though that if you had PPI on the original Loan/Credit card/Mortgage etc and you have a case for the PPI being mis-sold then you should surely claim it back. Cancel the expensive PPI policy and get a cheaper one online but you must at all costs ensure you have coverin the eventuallity that you cannot meet the repayments.

 

The aim of the game is to get the data, prepare a claim, submit a claim, take it up a notch to the FOS or Court, wait for weeks or months and then put the money back into your account. The FOS are currently upholding 90% of claims and if you submit a complaint to the FOS it will cost the other party £500 for the FOS to deal with it :eek:

Bit of a long shot this one I think.

 

2003 PPI on loan of 60 months (online application) There were no explanations regarding, other companies products being available, no questions relating to pre existing conditions which may effect cover etc. Also at the time I was entitled to full sick pay from my employer and now believe this would have prevented me from claiming as well.

 

Defaulted on loan and am paying via a DMP with CCCS I was advised to cancel the PPI as it would be void anyway due to DMP reduced payments.

 

I was told by A&L I could not cancel unless I refinanced the loan. Consequently I'm still paying the balance of this useless product and will be for another 5 years.

 

Is this correct? Do I have a case to a claim a refund of payments made?

Pop along to the fos website and download a copy of their consumer questionnaire and complete it.

 

Do you have copies of the loan statements or a full record of all payments made against the loan?
