Another Stuart Higley letter arrived today:

 

"I regret that there is little that I can add constructively to my last letter and note your proposed course of action. I have alerted our lawyers and litigation department accordingly. May I please remind you that the address to use when initiating legal documents is that of our Registered Office, below. Thank you for letting me know of your intentions."

 

I think we now have to wait till the 14 days we gave them are up before we continue. Am I right?

I have a question:

 

Is it just me or do NatWest always ignore the fact that they've been sent a S.A.R. which asks for much more detailed information than the copy statements they send (in my case even those being incomplete)?

 

If I wanted to take them to court for non-compliance (their 40 days are up on the 17.09.) do I have to physically go to court as described in the FAQs to do so?

Sooo...

I've printed the Information Commissioner's Office complaint thingie off their site, copied all the letters that went back and forth...and am sure this won't be classed as "a letter" according to the new mail prices anymore :roll: Thicker (!) than 5 mm for sure.:-D

Moneyclaim will be started on Monday.

Don't know if I got all the info from Natwest but I got several pages of notes in addition to the statements.

I have had a full SAR request from NWest only cos i want a loan agreement from them that they "cant find". I had about 7 big packs of info sent to me on my whole account. They sent it to the WRONG address to somewhere i have never lived but thats another story, i would send them a letter to the address Retail Regulatory Risk dept in Edinburgh asking for a full SAR and they will comply, after all you did pay for it!

Having issued our claim via MCOL I thought I'd send NatWest's litigation dept. another list of charges. This is what I've come up with:

Referring to my claim issued on 12. September 2006 (claim number 6QZ62756) please find enclosed a detailed schedule individually listing all charges and interest levied from my account with the account number XXXXXXXX.

I would like to draw your attention to the fact that the attached schedule includes the account number (XXXXXXXX) and sort code (XX-XX-XX).

By doing this I want to keep Cobbetts from asking for these details at a later date. I know it might not work, but who knows, it maybe will. I am, after all, sending it to NatWest's litigation department.

Also: got letter from Northampton County Court telling us our claim will be deemed to be served on the 17th September.

They have until the 12th to file defense.

I have been doing some more reading in this forum today and must say I find it incredibly frustrating that the courts seem to be letting NatWest get away with filing late, in one case over a week late!:mad: Spells corruption to me.

 

I have a question: Do I have to send any papers to the court in Northampton (no one has asked for anything yet) or do I wait until I hear from our local court?

Today we received their defence and the CPR Part 18 request.

 

We'll send them the reply Martin suggests.

 

Can anyone tell me why this is still with Northampton County Court:?:

 

Anyway, will be busy today so will sort everything tomorrow and post on Monday.

We've returned the completed AQ with the £100.- fee. Also included copies of the letters we sent to NatWest and a list of the charges.

 

Cobblers got a "don't think so" reply to their CPR18 request, a copy of which was sent to the Court, too.

 

It's our local County Court now, we received a "Notice of Transfer of Proceedings" a few days ago.
