Dear All,

I've just subscribed to the forum as I'm dealing with some debts on behalf of my 77 year-old mother. She received a demand from MacKenzie Hall and was being harassed by phone calls from them demanding over £2600. I consulted this forum and sent a standard letter requesting a copy of the original agreement. They have returned the £1 postal order with a letter saying that no further action will be taken and, if they do not receive proof from their client within 40 days, the matter is closed. Mum nearly agreed to pay them £60 a month...something she can ill-afford to do. I've sent the same request letter to Wescot Credit Service for another debt she knows nothing about and am awaiting a response. This may not be over but it feels good being proactive on behalf of my mum. Will keep you posted on what happens

Lets not forget this is a CCJ and if you do stop paying for any reason they may apply for a bailiffs warrant amongst other things and it will all cost money.

I believe this person works for them by the sounds of it. Total rubbish that he is saying, Mackenzie hall are crooks and prey on the elderly and shall we say weaker prey. They havent the power to take you to court, if you have a ccj they are collecting for then go direct to the courts about payment not them, dont listen to anything they say, there **** bags nothing else with little more authority then your postman, and dont believe anything this Zooman is telling you.

Things to remember - the finance companies that provided loans charge extremely high interest rates. There are allot of people that repay their loans and therefore these companies make millions and sometimes billions of pounds worth of profit. They knowingly take the risk that some people will fall ill or become unemployed due to no fault of their own. The profits outweigh any losses through people that cannot pay. So do not worry about feelings of failure to pay. They know how good people will feel, through psychological research and they will use these feelings to their advantage.

People that cannot pay are protected by law. These companies also know that allot of people cannot afford legal advise and so do not know that they are protected and so cannot take these companies to court.

They will psychologically bully you, allot of people are not aware that is what they are doing, if it makes you ill, it is definatley bullying. If anyone phones you about your finance problems from debt collection agencies put the phone down immediately. Say absolutely nothing to them. It will not matter what you say it will make no difference they are highly trained to turn everything around to their advantage and they will leave you battered and bruised.

Always get paper evidence that there is a CCJ this must be provided. Do not pay money over the phone to people you do not know. Always insist on written evidence. This is your legal right and they know it.

Send them a CCA letter if the debt was pre 2007. All you are asking them to do is provide you with a copy of the signed credit argeement between you and whoever you borrowed the money from. If they can not provide you with this they have to drop the debt and no court in the land can force you to pay anything (in fact it wouldn't even go to court)... debt = dead in the water unenforceable! REMEMBER DO NOT SIGN THE CCA very important this as they may use this to knock up a false credit agreement. Also you will no the orignal lender no longer has you on file and you won't habe to pay anymore money to anyone, I have used this several times and it works (not worried about credit rating though). I hope this helps
