      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

thats the best we can do b4 september and then the close down. Were only closed from beginign of nov to middle of march DEPENDING on when easter is.

Noooooo, can't do any of those dates ggrrrr and I really fancied going to Gt Yarmouth 'cause I've never been there :(

norwich to yrarmouth is about an hour by train and they stop early. London to norwich is about 3/4 hours

Hi Godmother sorry to hear that! sounded a nice idea!Perhaps another time! I was wondering about it as Great yarmouth not to far from me and thought it would be a nice little outing sometime in future if i survive MBNA!

yes it sounds a nice idea! as me and OH are not to long a drive away from Great yarmouth! My hubby has been saying it might be nice to visit a seaside in summer!LOL:)

That's the trouble with living somewhere which is popular with the tourists GM :)

 

The summer is busy for us as it's brass banding season too :rolleyes:

bo i know what ur saying but i get lots of partly free days out due to being in a popular tourist spot.

 

trips to the beach only cost me a pack lunch, towels and clean clothes dont have to pay for parking as it walking distance and kids love it, what more can i want?

Yes that is quite a nice perk being by the sea!There are quite a few little place we visiited round there.Is the waxworks still there? Me and OH used to love looking round all those souvinear shops and having a giggle at the things they sold!I also think fish and chips seem to taste extra nice when we treat ourselves some at the seaside!It is years since we been there or to any other seaside! We nearly went to Southwold on our way back from a camel park we visited to treat ourselves to some nice seaside fish and chips but it was impossible to find a reasonable parking place ! so i suppose it is great living nearby and not having to worry about parking!

G.M. What about holding a meet in Norwich itself? More accessible country wide and more accommodation, then if people want to get a train to Yarmouth the next day for sea side visit, they can.

no there is one other i know of.

 

we did not have the meet as ppl could not get to it. We could always organise a new one but needs to be b4 the season closes as it will be rubbish if not. Or we could always do what overdone suggested there is a travelodge rite next to the bus station in Norwich

Hi Godmother

I would be interested sometime in future going to Great yarmouth meet but have to put everything on a back burner at moment as Restons/MBNA takeing me to court so not really up to making plans for moment,But hope to meet up sometime in future if things work out but will not be able to go to this one,I hope you have a nice time and plenty of caggers can get there.I was thinking about having one in Nottinham sometime for the Cag Crapital One Fan Club to view Crapital One offices and give Ellie a wave! LOL and ask to view our alledged agreements at same time but i would probably get cagbooted again:eek: and Ellie does not seem to want to respond to all our requests to view our alleged agreements:D i wonder why!:D
