      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

As far as I can recall I have NEVER received anything with my right to cancel mentioned on it. I filled in the online application, the card arrived about 2 weeks later. That's it.

Egg are messing me about, with charges on charges etc, and any amount I am over my limit is purely charges now - and has been for a fair while now.

 

They refuse to communicate over secure messaging system with me 'because my account is with collections'. My argument with that is that I was told I could talk about my account via secure messaging when I signed up and I do NOT wish to talk to them via the telephone.

 

I sent them a letter I found on here (think it was BankFodders_ about processing innaccurate information to the CRAs and that I did not give them permission to do this and that I believe that the amount I owe is not correct - due to charges - so they should stop telling CRAs ab out the status of my account.

 

Furthermore, I was having one hell of a time getting my SAR info out of them - had to go all the way to court - in the meantime, I asked them to refund me the charges I could see on the last years info I can get online. I sent this via secure message about 8 weeks ago, and they have simply said my account is with collection and they will only deal over the phone.

 

Despite all this going on, as well as me asking for a copy of the termination notice (we can't respond to you as your account is with collection), I got an e-mail yesterday - how come THEY can do what they like via secure message?! They have now defaulted my account, despite as far as I can see there being a number of disputes going on with the account, including a request for a refund of charges, an outstanding SAR, a notice telling them to stop processing my data, etc. Where do I stand on this? Can I tell them to get the default off? Is there anything I can do about this?

UPDATE - got a default judgement against Egg on 24th Feb - only found out today when I rang the court as I hadn't heard a thing. Egg haven't paid up yet at all. They haven't provided any additional documents either.

Hi,

I stumbled across a couple of your threads as I was looking for advice on non-compliance with a Subject Access Request - Alliance + Leicester have sent me a big fat nothing and I am considering court. I wonder if you could tell me what was in your Particulars Of Claim and how much you claimed from Egg?

I have asked egg for my charges back, and after eight weeks, they have said that they think they are OK to charge and so wont be refunding them. what is my next step?

 

they are all sixteen pounds charges, but at the moment, all that is going ON to my account is charges, and it was one of the terminated ones, and bmy balance at the moment is two hundred pounds OVER my credit limit purely in charges. they issued me with a default notice at the beginning of march, giving me 28 days to fix the problems, but last week, sent me a letter saying they were starting legal proceedings beforethe default notice expired.

That is ALL it said. I know Egg were about to default me - don't get me started - and I told them the acccount was in dispute, and they couldn't - and anyway, they terminated my agreement a year last January.

 

However, this e-mail looks really unprofessional, doesn't state who they are working for, or really who they actually are.

 

Plus, I only use a mobile phone, so no WAY are they getting me to ring and 0870 number.

 

Does anyone have an address for these lot so I can tell them that the Egg stuff is in dispute, and to go away?

How strange... I got the same email from them today too. Why would a chicken company be contacting me?
