What terms are not covered?

Most standard terms are covered by the UTCCRs. The exceptions are those:

 

that reflect provisions which by law have to be included in contracts

that have been individually negotiated

in contracts between businesses

in contracts between private individuals

in certain contracts that people do not make as consumers – eg, relating to employment or setting up a business

in contracts entered into before 1995.

Surely if the bank changes their charging structure after 1995, that is effectively a new contract? It must be because it's not the same as the old one!

I agree. I think that it would be very disingenous for the bank to vary the contract after 1995 and yet still calim that it was the pre-1995 contract.

I would love to see this argued in court

They've certainly argued with me before on a couple of occasions that their current T&C's supercede the original ones.

 

Therefore they can't then argue that the contracts are pre-1995.
