I know that defaults stay on file for six years. But how does it work with subsequent defaults? For example, below is the last 6 years of one of my credit cards. As you can see, the original default was in July 2003 which will drop off in July 2009. What happens with the more recent defaults?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Is there no consistency on what entry a creditor makes? This account, my creditor has shown as in default since when I entered a DMP. Yet, another creditor shows payments as being made on time and the account as being normal status even though I'm on a DMP.

Further to this, it was a Bank of Scotland Visa. Blair, Oliver, and Scott were dealing but then passed it on to Wescot. I settled this account with Wescot in August 2007, paying approx 75% of the outstanding balance, and it was agreed this was a final settlement. Blair, Oliver, and Scott then passed it onto Apex who contacted me around August 2008 to say I still owed the remaining 25%. I told Apex I was disputing this as I'd paid Wescot. After a couple of months of harassment from them, they let off and referred the account back to BO&S, who in turn contacted me in October to try to come to an arrangement. I phoned BO&S and the woman acknowledged the money I had paid, and admitted that Wescot were bad for not notifying them of settlements etc. The woman said she would contact Wescot to confirm the account was settled and to phone back in 10 or so days. I phoned back and the account was closed and was told they would not pursue me for the remainder.

 

Can anyone advise on where I stand with regards to getting my CRF showing the account as settled in 2007, and having the entries after this date removed?

Firstly, there is no subsequent defaults (or should I say there shouldn't be!) you can only default an account once. What company is listed on your credit file for this account, Bank of Scotland, Blair, Oliver and Scott or Westcot. Whichever it is, you need to write to them, with the proof of settlement and ask them to update your credit file.

 

They might update the file with "Partially Settled" considering you only paid about 75% of the balance, but like you say it should drop of the file in July 09 anyway!

HBOS are the company listed on the record. I have no proof as such, BO&S never confirmed it in writing. I think I'll have to contact them and ask for proof.

 

I'm confused here, Can I ask for the default markers on the record after July 2003 to be removed?

BO&S have already agreed that the account is closed, as per your earlier post, albeit on the phone. Write to them, with all the information you have, telephone calls etc. and get them to confirm that the account is settled and get them to update your credit files!

 

The default markers are just updates of the original default. You should have on your credit file the "date of default" which should be approx. July 2003. This is the important date and should not change. The subsequent markers are just the company updating the credit reference agencies about your account i.e. if there were any changes to the balance outstanding etc.

 

A default is a default is a default whether it be settled or not. Whilst the account would look good as settled in your eyes, I doubt it would make much difference to any potential lenders etc. as all they will take notice of is the account is in Default!

 

Have you claimed back any charges on this credit card?

I'm sending a letter on Monday, the jist of it below. Anything missing? Should I quote specific sections of the Data Protection Act?

 

 

 

To Whom It May Concern:

 

 

Account number xxxxxxxxxxxxxxxxxx

 

Further to my telephone call of xth, xxxxxxx xxxx, I am writing to ask that you send me written confirmation that this account has been settled by payment of £xxx.xx made to Wescot on xxth, xxxxxxx xxxx. In addition to this, I ask that this letter confirms that I will not be further pursued for payment in relation to this account.

 

Upon checking my credit reference files, I note that the account is not yet marked as settled. I require you update my credit files to show this account as settled on xxth, xxxxxxx xxxx, and that the subsequent entries on these files are removed.

 

I appreciate your cooperation in this matter and look forward to your response.

I was really interested with your comment (only one default can be issued on an account), and not wishing to hijack this thread, but I have a default for £125 (Halfords/HFC) over charges applied to the account when I moved bank, and it was passed to a DCA who after some correspondence defaulted the account again!! After more correspondence, the original default was removed and the new one issued some 15 months later.....Should I persue it??

when a finance company default you, its recorded on your credit file

the account is sold to a dca.

the original finance company will then show as settled,

the dca will register the default in there name, but,

 

the dca default will be the same date as the original finance company

 

15 months later is a joke

 

demand the default be backdated to the original default date or you will be sending a report to the ico office

 

all correspondents about this default to be made to the dca as its there default that is inacurate

I'm not going down the credit file route just yet. I don't believe I have ever signed a CCA for this card, so once I get the magic F&F letter from them, I'll CCA Bank of Scotland. That way when they don't produce, I have sufficient grounds to have the account completely removed from my CRF, do I not?

yup. unfortunately i am having trouble getting through to the missus on priority spending and cutting back on luxuries. never mind paying off your overdraft which cahoot are intent on defaulting, pay for a holiday instead. wimmen!
