I have just had a charge for £38 added to my account for non-payment of direct debit. I am now overdrawn and they will probably charge me another £38 at the end of the month because of this.

 

Whilst i am happy with how i can attempt recovery of these charges, i was wondering why NatWest can charge on the same day as the incident (or think they can)?

 

Other banks write to you and explain that you have defaulted and that they are about to charge you, and usually give you some indication as to when the money will come out of your account. But NatWest just took it out on the same day wit no notice to me.

 

Surely they are obliged to give you at least 7 days notice.

 

Any help will be much apreciated as i have an appointment with my bank manager and would love to be able to quote something that he can't dance around.

 

I have already had 2 charges quashed recently so i doubt that a phone call would work.

 

Anyone????

The £38 is an unpaid charges and the other charge should be £28 not £38 which is preadvised. The unpaid charge is not one where notice is given, but the Maintenance charge is.

 

 

They will not refund further from a phone call. I think you need to start or add to any existing claim against NatWest.

Why do other banks give notice, yet NatWest dont?

 

I never comment on other banks I don't work for....

the guy from natwest told it was in the terms and conditions of my account that they dont need to tell you that a 38.00 pound charge is coming out of your account ,i told him am on benefits with 4 kids he wasnt interested so i told him i put a claim in for it back,which i wont get back until the test case is over ,even then i might not get it back ,i ve sent a letter to there head office to complain about people on benefits and being charged ,its unfair, might not get heard but i feel better for doing it why dont you do the same

It may be unfair but it is still lawful at the moment. I would look at claiming them back under the FSA Waiver on Hardship, Anex 2 page 10 for reference. It should be on my signature but I have signatures switched off so it should be on my profile here.
