More news, this must be Egg month at the FOS!

 

Egg card PPI complaint now with an adjudicator. Not holding breath on this one as this is the one think Egg may win this one although my credit agreement shows no PPI, they are showing screenshots of me having it.

Will wait and see.

Ok they show screenshots of you having it but make sure those screenshots reflect the fact that the little box with the tick was not a little box with a tick that was preselected and you would have to uncheck the box not to want the PPI. preselected boxes have been used by another company with online applications and they have just lost their case. Online applications should not have PPI boxes already marked with a yes I want it. The box should be empty allowing you to select PPI if you want it not the other way round.

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

First of all well done, great result for you pinknico!!

 

I have started a court case trying to get PPI back for credit card and loan taken out to pay off credit card; card was taken out around Oct/2002 and loan April/2004. Egg have until 5th Aug 2009 to defend (thats when their 28 days expires)

 

In one of your posts you state that FOS confirmed that PPI was pre selected for loans taken out online in 2004? Do you have any info you can give me which says this? is it possible for you to post the correspondence? (minus any personal details of course), it would help my case greatly.

 

Also how long did you have to wait for the FOS to deal with your case? I have another PPI claim that I would like the FOS to deal with.

I have waited 7 months for my case to be looked at by the FOS.

 

The pre ticked box in 2004 was information provided by Egg to the FOS in the format of web pages, I do not have these they are only referred to in the adjudicators report.

I expect Egg would have to provide these if they supported your court case?

7 months, I better start the process now :eek:

 

Does the adjudicators report mention what information they were supplied with? ... if I don't ask the right questions Egg will not volunteer the info themselves.

 

Did Egg confirm to adjudicator that all applications that year would have used the same web forms etc?

 

I know I am asking a lot of questions but any extra advantage I can get over Egg would be great.

Pleased to help the phrase, in the Adjudiacator report reads:

" I have seen the web pages that Egg says were being used when this sale was made in Feb 2004.

 

The online application process commenced with the consumer being required to input the amount of loan they are looking to borrow and then enter either the monthly amount they wish to pay or the term they wish to pay the loan over,there is no mention of PPI at this point.

 

The next stage of the process provides a quotation of the monthly loan repayment amount required to finance the loan ,the term and rate of interest. A PPI policy is automaticly included within the loan quotation. Whilst I accept there is an option to select "no" this could be overlooked as the pre selected option is "yes" end quote

 

 

So only Feb 2004 is mentioned but I doubt they only did this for a month and you want the web pages showing the sale process.

When/if they send their defence I will request the information.

 

I have tried to get them to give me the web pages of the application but they just ignored my requests and sent application review information with loads of information blanked out, guess now its a court case they cant side step the issues :grin:

Well done PN and thanks for posting.

 

We have just let our old Egg agreement sit in the background. Thousands outstanding on the loan but we haven't paid a penny for over 6 months and heard nothing.

 

Now I hear in the media that consumers are winning 99% of their cases against Egg.

 

Your thread has inspired me, and I think we will put in a complaint - thanks again.
