but this has been going on since 12th september 2008

 

isn't it about time you stop baiting them and just ignore every silly letter you get.

 

no one has gone near court

it's obv they won't

 

but you keep writing

they'll keep marking you as a mug that just wants fleecing.................

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi All

 

Just a quick update to this thread, i received a reply to the letter i send IQOR yesterday, they also sent me a complaints procedure telling me what to do if i have a complaint lol.

Not been on here much lately still been sorting things out at my end.

Just to let you all know had a phone call on my mobile, woman said are you so and so i said yes.

She said you need to pay Xamounts off money today, i said put in writing and send the original agreement to me.

Didn't give her time to answer and put the phone down, now tonight have had silent calls starting on my phone.

Any ider what to do, or should i wait and see what happens next. Remember on my thread, Halifax is the one with no original agreement.

I find the more you write to them , The more Amo you are giving them ..I have ignored ever letter for over a year now ,And Ive heard nothing ..Not even a Phone call!! All mine will be stat barred in 18 mths ..My OH is in the same situation ..He has heard nothing either ..Only the odd letter offering 50% off ;)

Gazza, just keep responding with a copy of the letter that Undercover elsa provided for you in post # 347.

 

You could add that their attempt to harrass you with silent calls will be reported to the OFT and OFCOM !

Hi All

 

Thankyou for replying to all my threads, you have all been a great help in giving me advise on these matters.

Update on this halifax thread.

Received a letter from them today, notifing me that Bank of Scotland has asigned all of its respective rights, title and interest in respect of the referenced account.

(including the outstanding balance) to 1st Credit (Finance) 5 Ltd. effective 31/07/2012.

 

Now does that mean that Bank of Scotland had handed my original agreement to them?.

As i understand it they couldn't find my agreement for this in the first place.

Gazza, I doubt very much indeed that HBoS have provided 1st credit with any paperwork at all ! Just an account number, your name and address.

 

If the Notice of Assignment has been sent from HBoS then I wonder if it might be worth writing something along the lines of the following...

 

Send the letter to their Head office/Registered Office and send it by a tracked method.. either Recorded or Special Delivery mail :)

 

Dear Sir or Madam

 

Account references

 

FORMAL COMPLAINT

 

 

I am in receipt of your Notice of Assignment for the account above.

 

Would you please confirm that in assigning this account, you have provided 1st credit with a copy of the agreement that I have been requesting for (however long or since DATE).

 

If you have not provided them with a copy of the agreement, then you have knowingly sold an account which is in dispute and should they make contact with me, I will be advising them of this.

 

Yours faithfully..

The last payment i made on this was around Augest time 2008.

 

So i'm looking forward to see what comes through the post.

The woman who phoned me on my mobile last week, must off been from 1st Credit.

Shame i put the phone down on her, i must remember not to be so rude to her next time lol.

My halifax account has also been passed to 1st Crud..I had a app form sent has a CCA and a dodgey DN only giving 6 days to rectify..The account is still in dispute with OC..with be sending a SAR to Halifax..And a dispute letter to 1st crud..The NOAI received came in the same envelope as the 1st crud letter ..Deff been printed off by 1st Cred..ere we go again ;))

Just an update, received a letter from 1ST Credit today demanding money.

Send a copy off the application form, and trying to make out that it's a credit aggrement/Contract that i signed.

Here's a scanned copy off the letter that was sent to me.

Halifax definitely useda dual purpose app/agreement form I have one in front of me now, so imo this complies with sect 77/78 CCA '74.

Some details are proveded separately I know my BC agreement has only the word ''credit limit to ba advised''.

Different parts of a documents my have differing codes.
