I think I may have one.

Currently being hounded by Link over MBNA credit card.

 

Now received my third CCA from link.

All three have been poor microfiched copies.

 

Is this the sort of thing you mean?

I think i have on the basis that they have not responded to my S.A.R or CPR 18 requests now at the A.Q stage and still no docs.

 

Yes they still intent on pursuing me for the debt but cannot provide the evidence to prove it

Finally if you succeed with your claim please consider a donation to consumer action group as those donations keep this site alive.

For some reason I can't get the 2nd page to paste onto here.

This is the page that probably should have the prescribed terms, but it's the copy is just so poor that it's very difficult to make out.

Thanks, it doesn't look like it's got all the prescribed terms on it, and also it's headed "Application Form" when in fact, even though an agreement can sometimes be combined with an application, it should be headed up "Agreement regulated....etc) - however this is a bit of a technicality.

If you really can't read it well enough to check for the prescribed terms, I would certainly be asking them for a legible copy.

Three requests and three times they've sent me the same

microfiched copy.

I'm sending off today for the fourth one. :)

Someone on CAG has given me the template of a letter to

send to them

Hi LB - nice to hear from you after so long! Am posting below "Agreement" the very top line of which is illegible on here but says "applying for a Virgin Credit Card couldn't be easier etc etc". It was sent with stapled current terms and conditions.

 

Today have received a default notice wanting arrears of £896 by 19th september or they will take court proceedings to recover the whole amount. Not sure if to cave in and pay just to get them off our backs - I am so fed up with them:???:

Tinkerbell, can you post up your "agreement"?

 

 

They haven't got a copy at all. They told the ICO that they didn't get it from Abbey when they took over the Credit card. I know I never signed one as I was asked at the counter in the branch if I wanted it and then they just sent it out. However they are saying all they have to produce is the reconstructed copy without my signature. So court here we come............
