I joined a contract with O2 carphone warehouse 9 months ago as part of a deal entitled swapit. I was promised I could return to store anytime between the 9th and 12th month and swap the phone for a new one which I was told would be free if that phone would be free to a new purchaser on the same contract as mine. On returning to the store was informed couldn't swap as system wasn't properly set up and wouldn't be for a month!! Also, on enquiry told due to the expense to the company a phone which is free to new customers on my tariff would be £240!! The part about price of phone not written in contract but where do I stand on being denied an upgrade for a month?

You'll need to read the T&C of the Swapit scheme as these will run in parallel to the airtime contract. From what you say, they are claiming a systems issue is preventing the process, but providing they don;t actually deny you a phone - you'll be expected to be flexible on the dates. Perhaps you can turn it to your advantage and perhaps get a free case, 12v charger to cover you enforced delay?
