We have a HSBC c/c which is in arrears, I must add that this is from the USA, (we lived there for a while), have no problem paying it but other priorities on our return and only now addressing this.

 

There are lots of charges etc on it by now and have been offered a settlement figure which we cant do, fella has now called several times late at night despite being told about time difference, last call at 2pm this morning waking the whole house up including 3 children.

 

Told hubby he needs to get charges off and interest stopped, but what I want to know is if this fella ( DCA) wont play ball can they actualy enforce collection seeing as we are now in the UK?, want to have a bargaining tool up my sleeve if possible.

If I understand it correctly, this is a US-issued credit card for which you are being chased by a US-based DCA. If this is the case, then whilst you may not be able to claim a refund of charges, neither will the DCA or OC be able to enforce the agreement here.

 

You may like to remind the DCA that any business undertaking debt collection activity in the UK requires a consumer credit licence issued by the OFT; unlicenced activity is a criminal offence.
