I worked for this agency for 5days and now because i jumped contracts they are refusing to pay me. I received the below letter i just taken address's out.

this is the only thing i signed and returned to them, they didnt send me anything else. I would of expected a terms and conditions but nothing. After phoning them they said i needed to give 1 weeks notice now where does it say that in this contract.

Start Date: Wednesday 7th June 2006 – Sunday 31st December 2006

£60/day for Shadow Day (accompanied day on site)

£90/day

 

 

Overtime Rate: Not applicable

 

Expenses: Business mileage expenses of 28p/mile payable for training day only

Mileage expense forms must be completed and submitted with an authorised signature to Concept IT.

 

Termination: Completion of contract is mandatory

oh so its ok for them to terminate u in a day but we have to give a weeks notice

Where does it say they can terminate you in a day?

 

You asked a question and dw190 gave a perfectly reasonable answer.... probably not the one you wanted to hear but if you didn't want opinions why ask?

also it was only faxed to them i still have the orignal, will that make any difference?

Is there any other piece of paperwork you've signed that gives a notice period.

 

If there were not T&C then, unless there is a legal requirement for 7/30 days notice or whatever, then they are duty bound to pay you for what you've worked?

 

I'm not stating that as a fact, just a question, more for the likes of david brent...

From the information in "The Agreement" the contract is for a fixed period of six months +. A term clear in the contract "Completion of Contract is Mandatory"

 

If you jumped ship after five days they may be able to claim from you any amount they have to pay over and above what they agreed to pay you for the remainder of the contract.

 

I feel sure that if you completed four happy months of the contract and they finished you, you would be wanting to seek compensation for breach of contract.

 

However, if your contract was "employed" by the agency you may be able to claim payment for the days you worked.

 

There are big differences between being: employed, self employed, contracted, contracted fixed term and sub contracted.

Sounds like i havent got a leg to stand on as they wouldnt give me the job unless i used an unbrella company or my own business :(

i used an unbrella company or my own business

 

This is the way they work so as not to have to comply with employment law.
