The Halifax have refused my claim for PPI to be refunded. Do they have to prove that it was dealt with correctly, and will a data protection request forcing them to provide this proof?

 

Also, since i have been in contatc with the bank, the 6 years have passed. Will the FOS still accept it?

Of course they are going to say that they did not do it:rolleyes: That is their first form of defense. and yes they do have to prove that they did not mis-sell you this expensive insurance.

 

A full SAR will only product information relating to your activity within that company. But it is worth doing it IMHO

 

As regarding the timescale for the Fos to investigate the claim, I do believe they will not investigate any claim taken prior to the Financial Services Authority starting to regulate financial services, this I again think is 2004-5. Of course your other option is the court route:-D
