Hi all,

Can someone please explain to me why, if this excessive charging is unlawful and bearing in mind the publicity, the banks are still making these charges? I am just starting on my claim road and am extremely nervous about it.

Partly because they are motivated by greed and they want to keep on making the money for as long as they can.

But partly also because they don't actually know how to stop it.

They have spent too long telling their customers that the penalties cover their costs and that they are lawful so now they don't know how to pull back.

If they now reduce their charges, many people will start saying that it is now proved that the charges are beyond the true costs of customer trangressions and will start claiming back all the harder. And we will encourage them

I think that they are in a double helix - the ultimate double bind: - an ascending spiral of greed entwined in a descending spiral of panic.

Now isn't that an elegant thought - except that in the middle there is chaos.

So are all of you really going to be brave and claim your money back? I really am scared about it, I'm all for challenging the establishment but I want to know that everyone else is doing the same and, coward that I am, that there will be no consequences

Of course there could be consequences, you could get your overdraft cancelled etc and easily lose in court unless you research the legalities..

UPDATE -

Claim submitted, HSBC have until May 13th to Acknowledge.

If you read through all the posts on the site you will see how many people have started claims.

As has been said before this is not an easy get rich quick scheme.

You must be prepared to go to court and present your case.

You could lose.

The bank could turn nasty - call in any overdraft, close your account. You should be prepared for that by opening another account.

Nevertheless, there have been many success stories

The law, in its majestic equality, forbids the rich as well as the poor to sleep under bridges, to beg in the streets, and to steal bread.
