      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ha - yes you're quite right! We banned a person for continuously breaking the rules and that means that our employers would be quite happy to give us the day off.

 

How would banning anyone stop us from getting on a train?

 

No offence, but a site with 10-15 active members is not really going to be 'spreading the news' are they?

 

We have jobs to go to, kids to feed, bills to pay. How selfish of us.

 

Also, it's not really that important. This is just to see if the UTCC regs apply. If they don't then the OFT have said they will go after the punitive v liquidated damages angle. This case isn't actually all that relevant.

 

Damned if we do, damned if we don't.

And yet, when we say the same, you circumnavigate the swear filter to call us liars.

 

And, as for the other sites being busy, if you must turn this into a competition - I think the current user figures for each of the 'other' sites speak for themselves - currently we have 4 times as many members active here at this minute than the next busiest.

 

I really don't understand this chip some people have on their shoulder about this site. The very site that most likely bought this issue to their attention in the first place.

Cos I am just a user looking for information back, You are the one who has spent his 2 years getting this far.

 

From all the threads on here it says there are 11 seats for media, obviously there must be some other rooms, or similar, for the other sites to get there info from.

 

If i had the faintest idea, or chance, of how to get a seat in there, I would be there.

 

And to be honest, you attitude stinks. I only asked if CAG were reporting from there and this is what i get back.

 

No wonder the other sites are doing so well nowadays

I answered by saying that we all have jobs to go to and families to feed - there is no way I could be in London today.

 

And again, if you must turn this into a competition, I suggest you check out the other sites to see just how much help and information is posted there and their 'doing so well'.

 

It beggars belief that people seem intent on attacking this site.

Dave, no-one mentioned how busy any particular site was. Who is turning it into a competition? you are the only person who seems to have a chip on their shoulder RE other sites

 

I dont have a chip on my shoulder about this site, and i am very proud of the work that was done initially.

 

My response was to what i considered a lame cop out of a response as to why cag are not represented today, please dont make it out to be any more than that.

I'm not sure you're reading the same thread as me:

 

Looks like the other sites that have got people at the case will be getting busy today.

 

No wonder the other sites are doing so well nowadays

It may be a lame cop-out - maybe the other sites have incomes that don't require them to go to work.

 

Evey one of our volunteers has a full time job - most have children as well, including myself. I can't just up and leave them at a minutes notice. For one thing, my employment contract required that I give 2 weeks notice for any time off - and with the date being moved around that would have been imposible.

 

I also cannot afford to get to London - it's just after Christmas and the train fair would cost the same amount as it would to feed my family until my next pay day. I'm not going to trade eating for getting to a court room to hear wether or not a case can go ahead based on the rules that the OFT have chosen.

 

I can also assure you that ONE user ASKING for his membership to be removed has no bearing whatsoever on this. I have no idea how you would think this would be possible.

 

Personally, I have trust that Stephen will no doubt post exactly what is going on. He's on the same side as us, despite what some of the users of his site (and this one it seems) may think.

No Caggers have chips on thier shoulders about others sites. Caggers don't go trolling on other sites. Other sites come here to do that, and for some reason in numbers.

 

We are all supposed to be in this together.

 

For clarity, CAG is a wealth of information that is not envious of any other site IMO.

So do I: the OFT, the banks and the judge. Or am I missing something? :-D

 

The OJ Simpson case, this ain't. I think when the judge hands in his decision (expected in MAY!) is when I'll get excited about it all, in the meantime, anything reported will only fuel more armchair lawyers all trying to judge the case themselves and trying to second-guess the real judge's final decision. :razz:

just as sarcasm is the lowest form of wit, i reckon accusing someone who challenges a statement of trolling to be pretty low also.
