      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I noticed Ms Knight's position on charges changed between the two videos on Oystar's site.

 

I would not like to be her. I think history has shown that subsequent generations look upon apologists in a bad light.

 

The body language between her and Martin Lewis speaks volumes!

I saw this on the day, great interview.

 

One thing that results from this interview is that we can now say, without any libel issue that:

Angela Knight doesnt always tell the truth!

 

That interview shows the above statement to be a fact. If there were any doubt, she would have wasted no time in taking action against Martin for calling her a liar on national TV.

Of course this is no news to most of you, but since that interview, it is at last official :p

I usually get those done at the doctors. Never had to have one done at the bank .:D

HSBC, you missed one. I quoted Martin Lewis when he used the same word (several times) on national TV :p

Pardon me for speaking my mind (and the truth) :p

 

Just because he said it doesn't mean it is true.

 

Quoting a libel, misquoted or not, is libel too.

No, I know, I'm not getting in a huff about it, he's perfectly right to edit it. Just highlighting what she said, when she knew it was not the truth. There is no way she wouldn't have known about A&L closing people's accounts in retalliation..

 

Just because he said it doesn't mean it is true.

I don't have such blind faith in Martin Lewis, but in this instance he was 100% spot on.

What is interesting is that she trotted out the old " the charges are for a service rah rah rah".

 

You know what is really interesting about this? Is the times I have been charged overdraft fees is because the previous month when my account went in to the red was because the banks fees took me in to the red!

 

So, can someone please explain just what service I am being charged for?

 

In my situation...the banks are creating the so called service!

You could argue, and I suspect the bank may, that the overdraft fee is an "informal request" fee to quote the newly updated T and C's. The Direct Debits being informal requests but not even I could justify the cost in a billion years.

The interview itself mentioned by Jamesrap was prior to the OFT announcing a test case against the banks.

I've often felt like I have had that at the bank though, but when I looked down, suprisingly, my trousers were NOT down by my ankles!

If this female has the nerve to come on TV and say a thing like my previous post she deserves everything she gets. Ex politician or not.

 

So should we now do a cca access request to the credit agency's?

IMO, they cannot charge for an account. It breaches the ECHR Act.

 

The Wages Act states that the employee no longer has the choice of how their money is paid. The ECHR Act states that no EC citizen can be forced to buy a third party product or service through local legislation.

 

Thus, every employee is effectively being forced to buy this 'service' from a bank through no choice of their own.

 

I can see another huge campaign coming up.

 

Why should I not have the choice to keep my money in a shoebox without the intervention of a third party, profit making company?

 

How dare any government force me to use substandard services that I have to pay for?

 

It makes no sense, and I can't see any country in the EU getting away with it TBH.

 

I couldn't agree with you more. It s a bloody cheek (at the very minimum) to be forced to purchase sub-standard services that are de facto designed to strip you of your hard earned money.

 

I believe that the underlying reason that this is happening is the governments (among many other sovereign nations) agreement to surreptitiously introduce electronic money and phase out "physical" money. This move has been long in the planning, as I understand it. Governments favour it because it is argued that it will greatly enhance tax revenue by inhibiting the earning of "black money" virtually impossible -- as all electronic money can be tracked and logged in a database. Banks favour it because it places all your money in their hands - a sort of subterranean transfer of ownership to the banks that you, the individual, will henceforward have to pay for to access and use. Commerce favours it because it reduces costs of handling and, in many ways, hands them the keys to your bank account (by use of the variable direct debit system etc).

 

The only group who do not favour it are the ordinary citizens. But since they don't have a meaningful voice anymore, they can be safely ignored.

 

And so they are.

Absolutely spot on, IMO.

 

It's a downright cheek, and legalised theft in my opinion.

 

It's so very unfair, that it actually makes my stomach hurt. I no longer have any Direct Debits or Standing Orders. No cheque book either.

 

However, I am STILL forced into having a bank account, and because of that, I am restricted to how much of my money I can have in cash in any given day. I cannot get to a bank as I am at work, and yet I cannot draw out from a cashpoint machine the amount I would like.

 

Excuse me for thinking that I earned the money and that it is actually mine to do with as I please.

 

I once asked for the bank to restric the amount of money coming out of my account by week (I was young!!!). They refused and said it wasn't their responsibilty to budget for me (yet, they called themselves 'personal bankers', which I found odd, as they actually did no personal banking for me at all). Yet, despite it being my responsibility, I am not allowed to take responsibilty for the amount I can draw out in one hit.

 

If I wanted to take all of my money out in cash each month, I have to give them notice of me doing it. Can you see that working? I can't. I gave Abbey National 2 weeks notice once of me wanting to draw out a large sum of cash. Do you think they got that right? Yeah, or course they did (note the sarcastic tone).

 

It took a bloody big argument in the bank (with them trying to shuffle me off to another room) before I was 'allowed' to take my own money. Money that I had given them notice that I wanted.

 

Just last year, I had to threaten to barracade myself in a Nationwide branch unless they let my Girlfriend have her money from her account (200 quid) - she hadn't yet received the PIN for her card (in fact she never received it and she had to order another one). She had a picture ID card, a rent book, and bank cards from another bank, and a bank statement from the other bank too. So unless someone broke into my house, who looked just like her and took her bank statements, there was no way she was anyone but the person she said she was.

 

I calmly told them that I would be barracading the door and no-one would be allowed in unless we had the cash in our hands there and then. He threatened to call the police, so I said "go ahead, then we can discuss your theft or at least your preventing access to private funds or property".

 

Strangly, the ID she had on her suddenly seemed enough to prove she was who she said she was.

 

Banks......Arrrggghh!

 

It's about time the OFT actually enforced fair trading instead of just paying lip service to it.
