i have also read somewhere ???? that the FOS cannot and do not have the powers to make any company pay even if they upheld your case is this true anybody got any answers ....................:confused:

The FSA do have the power to take court action against regulated companies that do not abide by their adjudications, or breach the FSA principles for business.

 

Regarding your first point, there is a difficulty in that the FOS are log-jammed with claims and are many months behind with cases. If you look through the threads on this forum you will find some cases where claims have been met - however, you will also find many others where the bank has challenged the initial ruling and cases are in the queue waiting for full adjudication.

 

The other thing that you have to remember is that the FOS can usually only deal with claims that relate to agreements made after January 2005. There are cases where they will look at earlier agreements, but usually these have to go through the court route.

i have got to the stage were the FOS have written a letter to Blackhorse to say they withheld my complaint and they have 14 days to reply (24th Dec) so i'm half way there............just got to see if Blackhorse will take their gloves off!!!!
