  1. Well got a letter from Westcott to say they would be taking no futher action and passing my case back to Abbey. I faxed at letter to Abbey asking them why they was going against the OFT guidlines section 2.8k " not ceasing collection activity whilst investigating areasonably queried or disputed debt" and to also ask them why they had also gone and took money from my account to pay charges when i only had Tax Credits, CSA and Child benefit payed into this account and this was illegal for appropriate such benefits and going against Social Security Administrations Act 1992.. It is a matter of public record that there has been correspondence between the Secretary of State and British Bankers Assocition Chief Exective regarding thia matter. I said this letter was a formal complaint and want a copy of their complaint procedure and a letter to confirm no further collection activity will take place while this dispute was unresolved and an answer to why they have gone against Social Security Administrations Act 1992 Section 187 by taking from my benefits. Given them 14days to reply or i shall report them to OFT,FOS and Trading Standards and i would not discuss this over the phone and all futher communcation must be in writing. So what do you think folks!!!
  2. well have have a claim for bank charges put on held awaiting the results from the OFT case...... As to date i have had 2 debt collections companys phoning me and sending letters for the same debt for scabby abbies overdraft all caused by bankcharges. After many phone conversations and faxes sent both companies have agreed to not upheld my case as the account is in dispute and i gave them my claims ref no and referred it back to Abbey National, well and beheld monday i received a phone call from yet again another debt collections company WESCOT ( round 3 ) i once again i told the same story pretty good at it by now telling them my account was in dispute to be told i still have to pay so much a month. i told them they was in breach of section 2.8k from the OFT guidlines and their request could not upheld and would like them to take my claims number and refer it back to scabby abby. Well today i received a letter from Westcot saying a debt collector would be calling at my house to collect the debt personally. I rung them and said by all means send someone round as without a court order they would pretty much be waisting their time !! they then said the money was now due to them and not abbey national so the OFT case had nothing to do with it, i said well thats funny because can you show me any credit agreement i have with you that is signed by me as i had an credit agreement with Abby National not you. Well in the end i spoke to someone else who took my claims number and said they would be sending me a letter to confirm that they no longer would be seeking this debt and passing it back to Abbey National ( Funny that thought i owed them ) they also told me to ring abby national to ask them why they keep passing the debt...so phoned scabby to be told i had not debt with them but only with Wescott ?????? and they had nothing to due with this debt anymore was owed to Westcot ????? Phoned Westcot to tell the the coversation i had had they took the number and name of the person i spoke to and said they would contact them as to ask why i was given this information. Does the right hand no what the left hand id doing ????
  3. well as todate still not received a penny spoke to blackhorse yesterday was given a figure over the phone for refund on first PPI, i asked why this did not include the payments i had mad for the ppi monthly coversation got a bit heated and the man from blackhorse was just coming out with all different figures, i have requested a full breakdown AGAIN phoned FOS (as much use as a fart in the wind) thay cannot get involved with the settlement figure and said the best thing to do would be for an accountant to have a look at the figures (more money) but they did agree that i should be refunded every payment i have made forthis ppi

I don't know if the above is true.... but i won my case for 2 PPI's by using the FOS service, it took from 16th october 07 till 10th january 08 all seemed to go easily for the FOS to get blackhorse to agree to refunding me with 8% interest giving them 28 days to pay. Now the fun has begun as to date i have not received any refund and blackhorse have requested a further 28 days and Fos have agreed. Have spoke to blackhorse and they given me a figure verbally over the phone for the first PPi refund and i have pointed out that this does not include what i had payed each month for the PPi and got into heated conversation with them, i then rung FOS spoke to my case officer and explained what had been said and she agreed this payment's should also be refunded to me BUT they can not get involved with this side of things and i should consult a accountant !!!!!!! So really they will assist you to prove you have been mis-sold but that is all they will do. Well good luck with what ever way you choose to go !

Blackhorse phoned me on 30/01/08 to say a cheque has been posted to me for one of my PPI'S refunds, Well still no cheque from Blackhorse Phoned FOS yesterday and ask what was going on it turn's out that the FOS have given Blackhorse not 14days extra on the 2nd PPI but 28 day's:mad: but i should still receive a cheque for the refund on my first PPi as they had only agreed an extra 28 day's on 2nd PPI. What's the point of setting dates for these banks to deal with these claims when they just set there own time scale, makes me so angry w*****s
  6. Well done :grin: I won my case for 2 mi-sold PPI'S from blakhorse by using the FOS. Blackhorse was told to pay refund back within 28 day's and that was up on 31/01/08. got a phone call from Blackhorse on the 30/01/08 to say they had only sorted out refund on one PPI and cheque was on it's way to me(still not received) and that blackhorse had spoken to the FOS reguarding the 2nd PPI claim and was given an extra 14 days to sort out:mad: I spoke to FOS yesterday and was told " O no we have given blackhorse an extra 28 days" i give up it seem's to me as if the customer always comes last!! What's the point of setting time and dates for the high street banks to still do as they wish. So i hope you get you'r payout easier then me and will watch with interest.........

Well blackhorse should of paid up yesterday as given 28 days by the FOS, well got phone call yesterday to say that only 1 of my PPI claims had been sorted and a cheque would be sent to me for the refund, but as for the other PPI refund this was taken longer as the loan was still running Blackhorse said they had spoken to the FOS who was happy to give them a further 14 days ( bloody cheeck) I asked why was i receiving a cheque anyway as i had requested the refund to be paid in to my bank account "o we don't do that :o I asked how much my rebate cheque was for and he said i don't know...... Blackhorse have been rude and unhelpful from the word go anybody would think they man dealing with my case was paying me back from his own pocket!!!!! So what should i do fax them a letter to say that if i do not receive a cheque for settlement for the second PPI within 10 working days i will be sendind them a N1 with out further notice ??????
  8. Did or have you got a copy of your Demands & Needs ? What year did you start theses PPI'S ? Have you got a copy of your T&C ? Was the statutory cancellation period ever explained to you ? Are you in full time employment or working min of 16 hours a week ? Was you ever told the PPI'S are optional ? Was you ever asked if yoy had any other insurance that would provide cover? Was you ever explained that these are single premium's product and that interest would be added to the price of the premium ? was the loan sold over the phone, if so have they got a recording ? Did they give you a price with and with out PPI ? Have a look at my thread, these are all question i asked. Good Luck ..... i'm not of any way a trained adviser but would be willing to advice you from what i learnt from my own claim.

Well spoke to blackhorse yesterday and asked why i was never given a full breakdown as i should of when the first loan account was closed, and the refund from the PPi on the loan was never discussed with me or was i ever told there was a refund which then took away my rights as to how i wanted this refund......he then replied with would you of rather had the money as it makes sence to pay it of your new loan making your monthly payments lower i said i have never missed a payment with this loan or anyother loan i have had with you, he replied well why would you want this refund i told him i did'nt need to answer that question but i want a reply in writting to why i was never given a break down or even told a refund was to come back from the PPI and how did i want this refund made to myself or off my new loan I had requested a full break down 3 times since October for ths loan, he then informed me as i had signed an agreement with the FOS this matter could not be taken up as i have agreed to this matter to be closed. WRONG as i have proof that i requested this 3 times and that the information was withheld from me until i had signed the form from the FOS and so i was not aware of this at that time and that they still have not given me any refund or have we agreed to the sum that is due to me. The FOS have said they can't get involved with this ??? but still agree they have got to pay me back everything else that has been requested by the 31st of this month. Blackhorse said that due to me signing a form with the FOS i can't take any court action for this other matter either ? To me this is a new issue to take up with them as they have taken away my rights and that refund was my money and for me to decide how i wanted it. I feel such a fool you put your trust in these high street banks for them to treat you like this where is their code of conduct ?? Anybody got a clue about this.

Hi Lizzy Yes FOS have told blackhorse they have mis-sold me of 2 loans the first loan was paid back in full with the second loan (first loan for £10,000 only run for 10months and the second loan for £5,000) so really had a new loan set up for £15,000.00 with a new PPI so 1st loan was cleared with new loan i hope that makes sence. But not once was we ever given any break down or even told the PPi money would be refunded or given any choose about the matter...... To be honest it never even crossed my mind as what would happen with the PPi money as i had not got a clue that the PPI was added to the loan never explanned to me assumed it was abit like a car insurance you only paid for it while it was in use not all paid upfront. Have spoke to FOS and they have said i should have received a full break down when loan account was closed and i would have been made aware.
  11. Phoned FOS was told they have 28days so to call Blackhorse to give them a nudge. I requsted a breakdown of how my first loan was was broke down when paid in full to restart a new loan as i had never received anything to explain what funds and fees cost ect, and after i had spoken to the FOS they said i should have received a breakdown of this. Well it turns out my PPIcost £4,411.00 not including interest and they refunded me £2411.00 of this but it was taken of my new loan back in 2005:-x and i not knowing anything about it or was it every discussed with me was not given any choose:-x surley this should have been brought to my attention and upto me how this refund was payed either to me or off my loan. Has anybody got any advice on this can i demund they also pay this back.
  12. FOS said if i did not hear anything from blackhorse within 14 days then to give the FOS a call so they will call blackhorse to see whats happerning, but did stress they should settle with 28 days..... will ring Fos tomorrow :-|
  13. Well still no news from blackhorse but then again for every day they make me wait is just more interest they have got to pay me:p

If the loan is still running your friend can ask back for every monthly payment he/she has made for the PPi with 8% interest from date of each payment till the day of compensation as a cheque written out to them and to have the loan put inplace as if he/she had never taken out a PPi making their monthly payments come down. Hope this is of help

Hi there Well done ,i have just had my case won with Blackhorse by using the FOS (still waiting for settlement figure) I had claims for 2 Mis-sold PPI's First PPi was from aloan paid back in full 2005 second PPi for a loan still running With the PPi that is fully paid the FOS have said they are to send a cheque for full settlement for full premium paid including any interest and charges, add interest on each of the additional payments made for this at the rate of 8% per annum simple from the date each payment was made to the day of compensation. With PPI on loan that is still running, they said re-arrange the loan by writing off all amount that remain outstanding in respect of borrowing for the PPI premium, including any interest and charges, so that in future the number and level of outstanding repayments against the loan are the same as would now have applied had we not taken the original loan sum without PPI cover. All premium paid to be paid back with 8% from the day of each payment to the day of compensation all to be received by cheque.   18. I WON !!!!!!!!!!!!!! got phone call today to say blackhorse agree to payout:eek: A big thank you to everybody who helped and the FOS:D Just waiting for blackhorse to let me know what they will refund me and FOS have said 8% is to be paid.
  19. FOS said Blackhorse will be in contact with me to let me know when they have worked out what my refund will be and they have said that they have told Blackhorse to pay 8% interest. Not bad as FOS informed on the 16/10/07 and FOS wrote to blackhorse on 10/12/07 to say they agree with me that PPI has been mis-sold.

Got a phone call and e-mail from FOS on 28/12/07, said they have rung blackhorse as they have had no reply and they was told the chap dealing with this is on holiday till 03/01/08 and had left a message to say he will contact them when he returns to work. FOS have now given them till the 14th January allowing them an extra 14days to reply, FOS said they had given them a few more days due to holiday period. Well who knows what happens next i dont think they are going to agree with FOS.

  23. Thank you for reply i have got to the stage were the FOS have written a letter to Blackhorse to say they withheld my complaint and they have 14 days to reply (24th Dec) so i'm half way there............just got to see if Blackhorse will take their gloves off!!!!
