Hi, trying to help my friend, she has just had a letter back saying:

 

"we assume that you have requested this information (SAR REQUEST) in order to make a claim for the refund of charge.....blah blah blah....

 

........However, the bank (and other banks) has now become involved in legal proceedings with the OFT in relation to bank charges which we believe will resolve the legal issues regarding the fairness and legality of your bank charges.......

 

.......it would be our normal approach to resolve any complain you may have through our internal complaints process as quickly as possible. However, until the determination of the legal issues in the above proceedings, we have asked the FSA to suspend the normal timetable for dealing with bank charges complaints, and the FSA has agreed"

 

Does this mean then that there is no point in sending the first letter demanding the charges back until this has been sorted, or should she send the letter anyway?

Yes, their letter is designed to deter you from following up your claim in the hope you'll forget about it. Carry on as per the guidelines. Once filed at court the claim is likely to be stayed, but at least the claim is in the system
