    Hi, trying to help my friend, she has just had a letter back saying: "we assume that you have requested this information (SAR REQUEST) in order to make a claim for the refund of charge.....blah blah blah.... ........However, the bank (and other banks) has now become involved in legal proceedings with the OFT in relation to bank charges which we believe will resolve the legal issues regarding the fairness and legality of your bank charges....... .......it would be our normal approach to resolve any complain you may have through our internal complaints process as quickly as possible. However, until the determination of the legal issues in the above proceedings, we have asked the FSA to suspend the normal timetable for dealing with bank charges complaints, and the FSA has agreed" Does this mean then that there is no point in sending the first letter demanding the charges back until this has been sorted, or should she send the letter anyway? thanks in advance xxxx lee xxxx
  3. hi, spoken to the court and they are ok about it being late in - phew! but was wondering, for now do i just need to get the court bundle which is on the bottom of your signature and print it off, send a copy to lloyds and a copy to the court. and then in the meantime get everything else ready (it the witness thing etc) for the big day? really grateful for your help xxx

  6. Hi, i've been sorting out this claim for my mum. I have succesfully claimed against HSBC & abbey myself last year, both I had to do MCOL, though they settled before any court date was given. My mum however, has not been so fortunate, she has a court date next thursday, i may have been a bit nieve thinking they would settle before!!!! ANY WAY, been reading through some threads and can see people mentioning court bundles and various other things..... im really confused now, what do i need to have for the court (for my mum), i've been reading through but im getting confused, if anyone can list it out in simple terms that would be great....as im not the brightest help much appricated!!!! xxxxx love me xxxxxx :lol: :lol: :lol:

  9. Hi all Im about to fill in my AQ, got all the info from this website to assist filling in, WHICH IS VERY HELPFUL!!!! However, i want to have the defualt for £128 issued against me 2 yrs ago removed (i have included this in my pre-lim & LBA, and particulars of claim' But is there anything in particular i need to put on the AQ?? thanks in advance lhp xxx

    thanks for your replys...... louis - no i got the defualt back in 2005, for about £130 (about 4 missed direct debit payments).....so it still remains against me i looked at that link, but, unless im reading it wrong, that seems like trying to get it removed on a competely different case, but i want to do it that when i get my charges refunded, they will also remove the default thanks for you help as well!! x

    Hi all i have sent both letters, and started my MCOL which has now gone as defence, but have just received a letter today from abbey offering me half of my £1750 claim - (NOTE: I WILL BE GOING FOR THE FULL AMOUNT), the problem is that, as i included on my 'particulars of claim' i requested that the defualt would be removed as part of my claim....as i got the defualt purely due to their charges.....but they have not mentioned this on their letter to me......do you think something like the following would be a good response?............ ---------------------------------------------------------------------- Thank you for your letter dated xx/xx/xx I respectfully decline your offer as Full and Final settlement and request, once again, that you return to me all charges imposed on this account, totalling £xxxx I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. As I mentioned in my particulars of claim, you entered a default against me which arose purely due to these charges in question, and i have requested this to be removed as settlement to my claim, along with the actual charges imposed. You have made no mention to this at all. May I take this opportunity to remind you that the court has the power to remove this, should I be successful, which I am confident i will be. If you decline to offer me this as a part settlement, then I will be pursuing my claim in full, along with the removal of the default, and will be filing my allocation questionaiire as soon as possible. Hi, I Know This Is A Bit Different To Actual Charges, But Anyway, I Have Recently Checked My Experian And I Have The Following 00001100200 (my Payment Profile), However As It Confirms This Was Settled In 2004.....i Know It Will Stay Against Me For 6 Years Overall......but I Was Wondering If There Is Any Way At All I Can Get It Removed???
